Timeline

Hello everyone, I hope someone can help me out. I am a little confused about eligibility for an advanced parole.

I will start with a little background just in case it is needed:

After a little over a year of asking my Fiancee to marry me I received my K1 visa and we set a date to get married

I entered the US on August 10th on my K1 visa and my wife and I were married that weekend as we had planned. We then applied with my paperwork for my AOS and EAD. I have received my EAD within the past few weeks so I should be able to start looking for a job. I never did apply for an advanced parole because I was under the impression that you could not apply for one unless you had a valid reason to leave the country (ie funeral, wedding, and anything along those lines).

I guess my questions are as follows:

1. Can I apply for an AP even without those reasons just to have it?

2. Can the AP be used multiple times or is it a one shot deal, once used you need to apply for another one?

3. Should I just wait for my Green Card before even bothering with leaving the country, considering I probably will not be going anywhere until after the new year at the earliest?

4. If I don't know a specific date when I will be leaving do I need to fill one in?

I probably will have a bunch more questions with regards to AP and or Green Card to ask and appreciate any answers I receive.

Yes - doesn't really need any particular reason.

2. Can the AP be used multiple times or is it a one shot deal, once used you need to apply for another one?

Usually they are issued for multiple entry.

3. Should I just wait for my Green Card before even bothering with leaving the country, considering I probably will not be going anywhere until after the new year at the earliest?

Up to you - also you need to consider not traveling, even with AP if you have ever had any issues with things like overstays - that can be problematic.

4. If I don't know a specific date when I will be leaving do I need to fill one in?

Specific date(s) not necessarily needed - can simply write 'spring 2010' or similar.

If you do decide to apply for AP - include your NOA1 from your I-485 and the fee will be waived.

Yes you can apply for AP. Just include a copy of your AOS NOA1 and it will still be free.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

1. Can I apply for an AP even without those reasons just to have it? Sure. Specific travel plans are not required, even though the form asks for them.

2. Can the AP be used multiple times or is it a one shot deal, once used you need to apply for another one? They can be issued for a single or multiple entries; you check the appropriate box on the application for the kind you want.

3. Should I just wait for my Green Card before even bothering with leaving the country, considering I probably will not be going anywhere until after the new year at the earliest? It can take up to 90 days to process an AP application, so even if you apply you may end up getting your GC first. That said, there's no cost to apply (other than copies and postage), so if you think you may need it, there's no reason not to apply for one. As others stated above, just include a copy of your I-485 NOA1 with the application.

4. If I don't know a specific date when I will be leaving do I need to fill one in? Nope. As Otto und Karin said, you could put a general time frame ("Spring 2010") or simply write "To Be Determined."
