I just got my K1 visa application sent back to me. I have a blue form that says "When you have complied with the instructions marked on this form, resubmit your petition(s)/applications(s) with this letter and all supporting documents to the address below.

"And then it says, "Please sign your application/petition with original signature in ink, as we do not accept signatures that have been photocopied, or signed and initialed on your behalf."

Is that what usually goes on a Notice of Action or is that what was wrong with the application? Because ALL the signatures are original! I really don't understand what's wrong.

That is why most people tell you to sign in blue ink. all you can do is resubmit the forms. A NOA would tell you that it was accepted or approved. Did you sign all your own paperwork? What you basically got was a RFE it think. Where did you submit it and where is your fiance(e) from?

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Did you sign the forms in black ink? If so, it may look like they are copies. Just resign in very blue inl and resubmit. Make sure you sign something that looks like a signature.

Are you sure you signed all of the pages that require a signature? Maybe use a blue ink pen to show them that everything you've signed is an original signature.

Make sure you've signed the 129F and all 4 copies of the 325A, your letter of intent, etc.

Make sure everything is signed in the correct place. If you signed it in the place for a "preparer" they will return it.

Make sure the fiancee intent letters are signed with origina signature. The G-325a for the fiancee does no tneed an original signature but many adjudicators are not aware of this. If the G-325a is not signed by your fiancee send it back with a letter asking that she be allowed to sign it at the interview, this is permissibale but sometimes the adjudicator overlooks this.

Anyway, I'll resubmit with blue ink (I think most of the signatures were signed in blue ink, but one wasn't). Do I need to redo the forms, or can I resign on the same form? I might actually just do both (because they stapled the check and the photographs to the forms I submitted).

What I received sounds like an RFE, but the page the sheet they sent me is blue and says "Notice of Action" on the top with a notice date of November 6, 2009. Not sure if that has any significance.

That is super silly.

Everything you receive from the is called a "Notice of Action" (hence the VJ slang "NOA") This is not an RFE (Request for Evidence) it is a Rejection. Look on the letter and it will say "Type of action...Rejection"

Re-sign all the same forms right above the other signatures. I used blue ink, it is something I always do on any originals even though they prefer black ink (black copies better) but I always want to be sure they know what is original and what is a copy.

A rejection is better than an RFE, it gets back in the system faster, usually. Take this opportunity to check everything again. they have not checked the entire package, they have only checked for signatures and payment (see the pinned topic above about exactly what happens to your petition at the SC) You could still get an RFE

I would doublecheck all your paperwork just to be safe, but I would resign in a felt tip pen or blue ink so it stands out.
