Hi everyone,

could anyone tell me if child support from an ex husband paid for a dependant child can be included on a I-864, and if so where?

Looking at filling the I-134 for our K-1 and just wondering if child support payments can be declared on there, and if so where, because I cannot see a place for that sort of thing, or is it included in annual income?

Yes, it can, as long as it's not about to stop (because the child is reaching 18 for example), dependable and documented. Add it to your total gross income figure and supply evidence (bank statements for example).

Oh, hang on. Just seen that you are just starting to file for a K1 visa.

You don't complete an I184 for K1, you do I134. At the London embassy, you only need this once you go to interview, so you may want to wait before completing it, as the likelihood is that a new tax return will have been completed by the time you get to interview.

But info still stands on how to include and evidence child maintenance (child support in the US).

Just answered your post on the AOS thread, but looks like you've worked out it's an I-134 you'll need!

I did deliberately do it in 2 sections, as I was curious for the AOS, where the affidavit becomes far more relevant than at the K-1 stage, tho i assumed the logic would be the same for both.

Yes. You need to attach the court order and proof of payment. Child support ordered but not collected will not be counted. Also, they can decline to cosider it if the child support will be ending soon. How soon? It is entirely up to them. Under a year...definitely they will not consider it. Over 3 years, definitely they will. Between one and three years...maybe.

How is it more relevent?

The I-864 is in many ways easier as it is more consistent than the various consulates. Follow the guides for the I-864 for the I-134 and you have no worries

Can you point us to anecdotal evidence of a Consulate rejecting the income from child support due to the remaining duration?

Can you point us to anecdotal evidence of the income from child support being rejected at the Adjustment of Status? Because I am unaware of any guidance to AO's regarding this matter.

Child support DOES count. We just had our interview on Nov 3rd and they had no issues with it in the London consulate. I showed bank statements showing the deposits and the actual court order. It was fine. It actually saved us cause I didnt make enough income!

Yes it can be included. It is part of your annual income. Add it all up. Then list source of income as your job plus child support. Child support is not on your tax return as it is not taxable. Attach your tax return plus the court order for child support and proof of child support payments, check stubs or whatever you have.
