Hi all,

A short question.

125% for 4 member family (3 of us already living together + my mom who I petition for) is $25,000. This means that the sponsor (or joint sponsor) needs to make over $25,000 annually, correct?

My husband will be a joint sponsor, since I'm not working at the moment, BUT he had (not anymore) a business that registered losses in 2007 and 2006. Would this be a problem, should I use another joint sponsor (not a family member)?

3/24/2010 - Case Complete !!!!!!!!!! Yee-pee !!!

This means that the sponsor (or joint sponsor) needs to make over $25,000 annually, correct? 125% of the guidelines for a household of 4 is $27,562 (more for Alaska or Hawaii) - a joint sponsor would need to earn 125% of the guidelines for his/her household size plus the individual being co-sponsored.

So, he needs to make 27,562 or more in order to qualify? Correct? I'm not sure I understand this right.

No losses in 2008 or 2009. He sold the business in 2007. He is now employed and makes around 40,000.

Correct.

Then he can co-sponsor and would provide evidence of his current wages, employment and tax returns. It is based on gross income (I believe it's line 22 on his tax return).

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Yes correct - your husband would need to earn at least $27,562 (which he does) to be considered as a co-sponsor for a household size of 4 (I'm sorry, i misread your original post and misunderstood that he was wanting to co-sponsor; I get it now, you are the primary and he's the co-sponsor). To calculate (for those unaware) the 2009 Fed. Poverty Guideline for a household size of 4 is $22,050; 125% of that ($22,050 multiplied by 125% or 1.25) is $27,562.

No losses in 2008 or 2009. He sold the business in 2007. He is now employed and makes around 40,000.

This is good (there is no real need to include income information from 2006/2007 because it won't help).
