Dear all:

I have a question at the moment.

My finace in the US and I started applying K1 this May and we have got our case approved in the US.

All documents have been forwarded to the London embassy. I am about to make an interview appointment with the US embassy.

However, now he has found a job in London so we are going to stay the next few years in London. We just want to get married in the US but come back to London immediately.

I was wondering in this case, do we still need the finacee visa? Can I leave the US immediately after getting married if I still proceed with the fiancee visa?

Yes, but you do not need it just to come to the US, get married and leave, You are from a VWP country, no visa needed to get married if you do not intend to adjust status

The K1 is intended for an immigrant, but they won't stop you leaving the USA after you got married. You can later apply for a spousal visa when you are ready to move back. An Irish VJer (not me!) just did that and got their second visa a few weeks ago.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

For a Chinese national, I think you should go for the K1. As you say, since you need a visa any way, may as well get one which is a bit more sure-fire to get you into the country. The costs are about the same (except the medical) and since you've already paid the petition fee may as well take advantage of that.

Just so you know, people who are not UK born citizens DO have a more difficult time getting through the London Embassy. Be prepared to show more documentation and answer more questions than the average couple going through London. Also have your mind set to expect to be put into administrative processing. I think your USC Fiance should try to attend the interview with you.

It's always best to be prepared for potential delays like AP but typically Chinese citizens need not expect an administrative processing after interview unless there are missing documents or unanswered questions at interview.

I agree that based on the circumstances described, continuing with the K1 is the best course of action for marriage in the USA. No visitor visa would be issued with the K1 process on record. Just remember that K1 is good for ONE entry to the USA. If you don't plan to stay, also don't plan to return to the USA without a spouse visa.

Yes, you can. You have now received more accurate inforamtion that I first gave you as you have now informed us you are Chinese and not from the UK. Including such details in your initial post will result in more informative answers.

Based on what you are telling us now, and assuming a desire to get married in the US rather than the UK then yes, get the K-1, go to the USA, get married and go back to the UK. You will not be able to enter the US again without another visa, but once marrioed to a US citizen you may be able to get a vistor visa fairly easy or even do a DCF in the future if tyou decided to live in the USA .

That is provided there aren't any other details you left out

At the London embassy, they generally put anyone who was not a UK citizen by birth into AP, unfortunately.
