Timeline

Maybe someone can help me here......about 2 years ago I was married and applied for I-130...case reached emmbassy, but during that time things were not going well and we got a divorce. I wrote the embassy a letter to withdraw the case and cancel it. USCIS received the case back from the embassy (state department) and i was notified by uscis that they received the case back and they would contact if they need anything.....have not heard back from embassy and or uscis anymore since 1/8/09.

Now that I met a new person and got engaged, I do want to apply for my fiance for K-1. Can I apply normally? do I need to know or call the uscis to check that I can apply?? please advise as what to do?

About two years makes a difference. More than two years since the last petition was approved? If it was more than two years, you are fine. If it is less than two years you need to include a waiver request, read the K-1 guides and I-129f instructions

Does anyone have any idea how the waiver form should look like? is there an example form somewhere on this site?

There is no form; you simply write a short letter, explaining what happened and why the first time didn't work out, and why this second time will :)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
