Hi, everyone

So I read the guides which have helped me alot but I am stuck with the I-864 form, I am legally married and live here in Las Vegas, NV. The issue is that my wife, only claimed $6000 on her 2008 tax return due to the fact that she was still living with her parents and was a full time student, she is now working full time since 03/2008 and makes well over the poverty line. How can I fill out this form? Can someone else sponsor me?

Any help would be great thanks

It sounds like you will need a co-sponsor. Your wife will remain your sponsor but she can use a co-sponsor - someone who does meet the 125% of the poverty level guidelines for their household number plus one (you would be added to their household allotment) - to fill out the I-864 along with providing the same documents as requested for the sponsor. You can read about using a co-sponsor in the guides.

Sure, show her income from last year, but show the current 'picture' as well.

Sounds like you do NOT need a co-sponsor. There is absolutely no requirement to make over the poverty line for this year with last years income. Her current income is what is important. First, SHE needs to fill that out, not you. Where it asks current income, state her current income, annualized. What is her CURRENT annual salary. she does not have to have had the job for one year. She can have the job for one month, but what is her current salary? Attach check stubs and a letter from her employer to verify that. Attach last years taxe return with w-2s but it is more or less meaningless as far as qualifying.

Yes, if she makes over the guidelines now, she will be OK. I would give paystubs back to March, but that is just me, a couple months worth ought to be plenty.

She meets the guidelines. No amount of co-sponsors will raise her income for 2008. Fortunately that doesn't matter as the I-864 is being submitted in 2009
