bringing my brother-inlaws girlfriend here in US(gf frm dubai)

hi guys..

so were really want to help my brother in law to bring his long time girlfriend here in US..she was in Dubai..we know that applying for fiance visa will take too long..so is it possible that she can come here in a tourist visa then get married and adjust status..?and she will never go back to dubai..?does my brother inlaw need to send an invitation for her to apply for tourist visa..?is she gonna face some problems if she will not go back to dubai(she works there but shes frm philippines)..?

thanks in advance guys..we really wanna help them..they want to be w/ each other..because they have been together for almost 5 yrs and want to get married..

Ahh technically that would be fraud. I dont see that she would actually get a tourist visa anyway if she doesnt have really strong ties to her home country...I have read where a girl did have strong ties to the PI and still got denied a tourist visa...how old is she? If they have been together for 5 years, what's another 6 month wait?

A tourist visa with the intent to marry and stay is fraud though. Have them do it the right way...either get married and do a spouse visa or just stick with the fiancee visa.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

It's fraud to enter the US on a tourist visa with the intent to get marry and adjust. It is a basis for denying entry into the US and possibly complicate a future attempt to immigrate to the US.

Your brother-in-law has a choice. Do it the right way which means waiting like everyone else or do it the wrong way and risk his and his fiancee's future together. Doing what is being proposed is the wrong way.

I think it depends on where she is residing at the time. If she is in dubai, it would be there. He can always call the USCIS and find out the answers to some of the questions he has OR better yet, he can consult with an immigration attorney with all the questions he has and only pay the attorney for the time that he answers the questions.

I am assuming your brother inlaw is a USC, right? If so, he can petition her for a K-1 visa. Check out the guides. I think she will process in Dubai, as long as she has legal residence there :)

This is correct. Just make sure to include a copy and a translation of her residence visa (which should be in her passport). We also included a sentence in our cover letter asking that the interview be held at the embassy in Abu Dhabi as we were living in Dubai at the time but I don't know that that was necessary.

Good luck and remember it's not a big deal that she is living in Dubai. Plenty of people have processed K-1 visas from outside their home country. She just needs to have legal residence there.
