work authorisation stamp on the I94

Hi,

I came in USA as K1 visa holder and on the POE in NY I received a work authorisation stamp on my I94. The clerk said that I could start working on the next day if I wanted. Than I found the information here on visajourney that I am not allowed to work until I receive my EAD card. Why do they put these stamps and give wrong information? Have somebody else received a stamp like this?

The K1 precess took us 9 long months.

AOS

09/25/09 - POE: JFK

10/05/09 - married on K1 visa

11/23/09 - filed for AOS, EAD, AP

12/21/09 - Biometrics

02/01/10 - received work permit and adv parole

02/11/10 - Card production ordered!

02/23/10 - Green card received

They didn't give you the wrong information, they only gave you part of the info. The EAD stamp you received at the airport is only valid until your I-94 expires. So that only gives you 90 days to get your Social Security number, find employment and start working, which in all reality is not feasible since most employers don't like to hire people who can only work for them for a few days. If you did find a job within the 90 days, you'd have to quit working for them legally until you receive your actual EAD card. So that's why people here say it's pretty much worthless.

Everyone (with the appropriate visa) going through JFK gets the stamp - has more to do with (I believe) the port/transit authority in NY than anything else. There was a time where you could have used it as work authorization but not any more - not sure why they still give the stamp.

Just get married, file AOS and EAD and once you get either of those you'll be able to work properly.

As Otto und Karin stated, you cannot legally work with the stamp anymore since the I-9 was changed this spring. There is a pinned topic in the "Working and Travelling" forum that explains more.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)
