Hi all,

I'm asking this for a friend who is getting the paperwork together to file her AOS. She and her son came over on K1/K2 visas and she asked me if there is an extra fee for her son's AP. I'm not sure so I thought I'd go to the source of all things great and wonderful........VJ! :thumbs:

I know that when you file AOS the $1010 includes filing for EAD and AP.....does this include the AP for a K2 child? Or will they need to pay the fee for filing his AP along with the $1010?

Her fee of $1010 does NOT include ANYTHING for her child. The K2 AOS is a completely separate filing. Each needs to file an I-485, and the other forms if desired. The CHILD's fee will cover the AP and EAD for the child, when filed. If the child is under age 14 and files with the parent (at the same time) the fee is $600. If the child is 14 or older or if the child files for the AOS separately, the fee is $1010.

The child needs to file all the same documents as the parent, forms, documents, I-864...ALL is separate. They need to include a copy of the I-129f approval notice with the child's AOS as well as a copy of the marriage certificate between the petitioner and child's parent. It is the AOS x 2

just to add, if doing a nonconcurrent later filing and the child is under 14 then the fee is only $930 (no biometrics fee required)
