Hi everyone,

Does anyone know what the rules/exceptions are about traveling outside of the US after fiance's arrival here? We are planning to marry and file AOS right away, and I had the idea to take a trip potentially outside of the country as a little vacation... When is my fiance oficially going to be able to travel outside of the US again, and are there exceptions to that rule?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All kinds of threads in this very forum talk about the matter. My own wife used her AP for a day-trip vacation to Mexico. As long as you have the approved AP form (in duplicate, until you use it the first time), it can be used for any reason. Readmission to the U.S. remains at the discretion of CBP at POE, of course.

You did not answer my question, what does USCIS say about the use of AP?

I know people use it for all sorts of reasons all the time but is it really correct to advise others that they can use it for any purpose knowing that USCIS have specific reasons for using AP and that is for emergent personal and bonafide business only.

Ive asked this question a couple of times already but I never got a clear answer. I've had an argument/discussion with a MOD in a different thread before but never got a clear cut answer. Once and for all, Id like to here what MODS have to say about this issue.

The business travel abroad is an example and should not be construed as an all inclusive limiting factor.

emergent can be defined as unexpected or unplanned

non-emergent bona-fide would be a planned real or authentic reason

between the two definitions, it would allow just about any about any reason

Planned real or authentic reason is your interpretation of "non-emergent bonafide" not USCIS. In your interpretation, everything qualifies as "bonafide".

Ofcourse not everybody would have the same interpretation of the law/rule. And like any other law/rule... there is always a loophole.

I will try to step away from AP topics from now on to avoid debates and/or arguments with other VJ'ers especially since it looks like i'm the only one who thinks that AP is specifically for emergent personal and bonafide business reasons only. That being said, I rest my case.

You discount my definition as not being the same as the USCIS's but yet the words are taken directly from the USCIS website... If the USCIS provides the specific definitions to "emergent" and "non-emergent bonafide" then please share....

If they wanted it to be limited to "bonafide business" reasons then they would have said it as exactly that... but they did not... they gave only a "such as"... and not a "such as and limited to".....
