should i get approval paper from my sons father when i dont put his name in my son birthcert to be with me in us?

me and my american husband filed ir1.ill be sending my ds230 sooner ,,,

im afraid in the future interview they might asking some papers from he's biological father allowing me to bring my son with me in the us ,,,

in my son's birthcertificate ,,i dont put father's name there ...

do u think i need to get that paper ?

i have already all the papers needed..thats the only thing im worried about ,,

please help me ,,,and enlighten me

I don't know what the law is like there, but here, if the father's name is not on the birth certificate, he has no legal right to the child unless he makes an effort to get custody. If you feel like it may even remotely be an issue, and it would not be difficult for you to get permission from the child's biological father, having a letter from him can't hurt, as even though it could serve to establish his parentage, he will effectively be giving up that right by writing the letter in the first place.

Maybe someone with experience in your country can add more specific ideas of what you could do... but personally, I think you'll be ok :blush:

In the Philippines, if you were never married to the child's father, he has no rights and no permission is needed.

In the Philippines, if you were never married to the child's father, he has no rights and no permission is needed.

Even if the father has signed the back of the birth certificate he has NO LEGAL PARENTAL RIGHTS unless he was married to her or has specifically sought and been awarded then in court.

My son's biological father signed the birth cert acknowledging as father, we simply provided the NVC with print-out of the relevant PH laws (see the link in my signature) and there was never a question regarding it.
