Hi,

Im am putting together my AOS package... and I dont think i have my husbands federal tax return copies!! We didnt submit one when we filed the I-129F for my K1 application... we just sent the W2 and his paystubs...

Is it ok just to submit his 3 years copies of W2 and paystubs for the affidavit of support? he is in the military...

You can contact the IRS and request tax transcripts for free for the last 3 years. Just call the automated line and request that they be mailed to you or you can have them fax them to you while on the phone with them. If you send the tax transcripts, you do not have to provide the W-2's.

The instructions are VERY clear. You must submit the tax return from the most recent tax year with the I864. You didn't submit that form for the K1, so the argument that you didn't have to before doesn't apply here.

GMJ is right, the easiest thing to do is order free transcripts from the IRS.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Thanks so much for the reply! I called IRS and requested for my husbands federal tax return copies.. they said they will be mailing it within 2 weeks... ill just have to wait for it then :)

No. They need the tax return for last year and a statement that of what he has made in the last three years and he needs to be current on his filing for the last 3 years. If he cannot find them, he can request tax transcripts from the IRS for free.
