3 qs: what to tell at border, which POE's give job stamps...

okay so last minute business:

do i tell them at the border that i'm going to my fiance's interview? i'm going by train and they just sort of pass through, but i'm worried they'll take me off the train and grill me. however then i can show them my beautiful and very organized binder ;)

secondofly, when my guy moves- are there certain POEs that give job stamps? to work? i've heard that? maybe i'm going insane. i suppose he'll be going through buffalo, so it would be nice if that is one of the places they do that.

thirdly, i had an important question that now i cannot remember because i did a double shift at work today and i'm exhausted. what should i be asking? any ideas?

The fact that you're going to visit your fiance specifically for an interview for them to move to the States to be with you seems like fairly good basis that you plan to return. If there is a stop at the border, I imagine telling to CBP would suffice, with a quick flash of your evidence if they so ask. But I can't imagine you'll be dragged off the train specifically for this. Not something I'd be concerned of.

The loophole that allowed K1s to work immediately following visa activation has been closed. Even if, by miracle of someone not having a clue about anything, your fiance does get a stamp (which I do recall reading about rather recently on the K1 forums, though I may be wrong), it's useless. They are unable to work until the EAD is produced.

I think you're set. We're all just extremely overly paranoid with not wanting to forget anything. :thumbs:

Good luck at the interview. You've been given the right information above. If the border guards ask the purpose of your visit just say you are accompanying your fiancee to his K-1 visa interview at the US Consulate. You'll have no problems.

The purpose of your trip will be to visit your fiance. If they ask for more information, then you can tell them about the interview... chances are that they won't really bother you though. I wouldn't volunteer any information that you don't have to.

Unfortunately no border gives the stamp anymore and to be honest, I can't really see an employer using that as proof of employment for the I-9...I'm pretty sure there is a specific list of things that would qualify someone and the EAD is our best/only option.

The EADs are done pretty fast these days (within 60 days give or take) so it shoudn't be too long before he can start working after you guys files for AOS.

all very good to know. especially about the stamp. i THOUGHT i had been hearing about that and i'm glad to know it wasn't just a fever dream/ hallucination brought on by the stress of this process :)

As far as I'm aware (please correct if I'm wrong), the co-sponsor isn't legally bound by anything, really. By truth and honesty in the form, sure, but to the point where they need to feel they're on the line until death for who they're sponsoring... no.

And the end point isn't death. At the latest, it'd be naturalization, but may be as early as permanent residency without conditions.

AOS is after you marry, yes. So tack on about two-three months after you marry, and that's the absolute soonest he could have his EAD (depending on how long it takes you to gather your work for AOS).

Are you sure? I thought it was a certain amount of years. I can't see a co-sponsor being binded after the beneficiary is a 10 year greencard holder or a citizen.

Yes, after you get married and file for AOS, you'll be approved for an EAD. It's one of the reasons some people opt for the CR1, since you get a greencard upon entry. Defintely plan for months of unemployment with some savings. That's what we did and we were fine. I was lucky to find a job right away, but also factor in a few months to actually find a job too.

Also, unable to work doesn't mean unable to look for work. There's no reason why your fiance (then-husband) can't be out and looking for jobs/interviewing and informing potential employers that he is awaiting his EAD.

Honestly, if you ever needed a public benefit, they'd come after you before the co-sponsor.

Yeah, I think that is the positive reaffirmation. The sponsor doesn't need to trust the potential immigrant, they need to trust the primary sponsor.
