Hey guys,

So my wife now has a CR-1 visa. Yay!! :)

We plan to make a visit in December, so she can get her Green Card. Now, here's the catch. We are not yet ready to move back, so we will be coming back after our short trip.

My question: Are there any requirements on how long we need to stay in the US after our initial entry? Could we, for example, enter and then leave after 10 days? Could us leaving after 10 days impact her getting the green card posted to the given address?

Thanks!

With CR-1 she gets a conditional green card, and this is valid until 2 years and you show that you are still married and then she will get a permaneant GC. Yes, she can enter for 10 days and leave and come back later. This is no problem and will not impact her getting the green card at the address. The visa that is stamped on her passport will verify that.

Cool, and I presume she can enter again on the Visa itself? (Once its stamped). I.e., assuming we don't wait for the Green Card, then, if we want to return, she should be able to enter on that right?

thanks

That is correct- the passport will serve as temporary greencard so as long as you have someone reliable at the mailing address who will keep the physical green card for her when it arrives, you are all set. Do keep in mind though that the green card- temporary or not- is for a Permanent Resident of the USA, so if you stay outside the US for a long time (more than 6 months usually, though it is up to the border guard), your wife may have trouble re-entering.
