Hello,

With the advise of member "pushbrk" I have decided to post this topic in the correct place. I am a US Citizen living in the US and my wife is a Vietnamese Citizen living in Vietnam. We were married in Singapore a couple of months ago. I am now understanding that since we married in Singapore, if we decide to file the K-3, she will have to do her interview in Singapore. My question becomes, would I have to file the I-129 and I-130 petition paperwork with the Singapore Consulate as well or with the Vietnam Consulate in Ho Chi Minh City?

1/17/2010-----> NOA 1 - Hard Copy

3/28/2010-----> NOA 2 - Email

4/02/2010-----> NOA 2 - Hard Copy

6/14/2010-----> NVC Processing Complete

8/02/2010-----> Interview Date @ 8:00am - Result = PINK!!!

No, you would file the I-130 & I-129F with one of the USCIS service centers in the states. After the petition is approved then you will decide what visa to pursue.. K-3 visa application in Singapore for K-3 or immigrant visa application via NVC with an interview at HCMC... Visa applications come much later in the process after the requisite petitions have been approved

This was already cleared up in the other forum. He'll file the I-130 only and take the CR1 path because he wants the interview in HCMC instead of Singapore where they married.

Facts are cheap...knowing how to use them is precious...

I already posted this over at the Asia regional forum. I know you and your wife married in Singapore despite the fact that neither of you have Singapore citizenship or live there. If you decide to follow the K-3 visa, you might want to inquire whether or not your wife will be required to live in Singapore for X amount of time in order to qualify for the interview taking place there. Just because you married there, doesn't automatically mean your interview takes place there hands down. I am sure there are other requirements as well. Best of luck!

You are not sure but I am. You need not be a resident to interview and if you aren't allowed to enter Singapore there would be no K3 interview or visa. This is all moot now, as there is no desire to return to Singapore for an interview and the OP has correctly decided to follow the CR1 path, not the virtually obsolete K3.

You are correct. I am sorry. I did not get a chance to learn of his decision to go for the CR-1 until just now. Finger, never mind what I just said :)

If the US C still has Singaporean Residency, and prior Singaporean residency, then it is possible for file an I-130 via DCF IN SINGAPORE.

But, ya gotta get back to Singapore and file it at the US Embassy in Singapore. If asked why to return to USA, tell them you had to secure a domicile for you and your new wife ( a perfectly valid explanation )

Have a Read on Direct Consular Filing.. see if you qualify..

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
