So I sent in my wife and my brother-in-law's I-864 forms together with a tax return statement for the most recent year, and now we got this RFE saying they never got it. ?!?!?!

What did you guys do with this form when you sent it in?

It's possible it got lost somehow or it got mixed up with other forms... Do you have a copy of the I-864 you sent in originally and the tax return. I would probably send it in again along with copies of the tax return and w2(s) and other applicable documents...

All we sent in was the I-864 for both my wife and my brother-in-law with a copy of their tax returns (form 1040A if I'm not mistaking)... maybe that wasn't enough :whistle: I also had to show proof that my brother-in-law is a US citizen... I'll go to H&R tomorrow and see what can be done.

I'm scared and excited all at once. haha

We sent the 1040 and the w2, plus 6 months pay stubs. If you don't have the w2 you can get tax transcripts from your IRS office.

Awww yep it's good they're working on your case and i'm sure it will all be fine.

We sent the 1040 and the w2, plus 6 months pay stubs. If you don't have the w2 you can get tax transcripts from your IRS office.

Ok thanks ! Yeah I'm afraid we'll have to get tax transcripts from the IRS because my wife can't find her W-2 anywhere... I hope they can email them instead of mailing them out to our home because that would take longer... I really can't afford to wait another 2-3 weeks (I got an awesome job offer and I want to start taking care of the family, but I have to wait for my EAD, which is dependent on me sending in those tax documents)

Aw that sucks, I think you can request them by phone. Or possibly go to an irs office and collect them. I'm not sure of the specifics though. I know it was posted somewhere. Possibly on the October filers thread as I-864 RFEs seem pretty common.

I'm completely confused now... so, my wife doesn't meet the poverty limits which means my brother-in-law is cosponsoring. I got the RFE after I sent in both an I864 form for my wife, as well as an I864 form for my brother-in-law, plus copies of their tax returns (1040A) for both my wife and my brother-in-law. I can't figure out what I did wrong? I keep reading about form 864A and I don't know what to do... Can anyone tell me what to send in exactly in my situation?

I'm sorry, who is petitioning for whom?

The primary sponsor must file a I864.

A joint sponsor will file a I864A if he/she lives in the same household as the petitioner or a I864 if he lives in a different household.

Proof of their citizenship/LPR status MUST be sent.

Sometimes they also ask for relationship proof, so both BC's will have to be submitted to show that they are brother/sister.

(All of this is applicable to CR1 so I'm guessing it'll apply to AOS as well).

I also got RFE related to I-864 and I-864A. My letter(2 pages) seems just long and not clear when I read it first time, but I could figure out what I missed and what I need to send after I read it again and again. I collected my sponsor's Passport copy, Employ letter from HR,and pay stubs for recent 6 months. I'm going to send it out included a cover letter and original RFE letter as requested. Same as the other dox, I made a full copy of this to keep.

I suggest you to read RFE letter carefully since that's probably the only clue that you can access with this matter(sadly)! And collect the dox as much as you can and send it out ASAP with cover letter to resume our process. Crossing my fingers for all the RFE receivers!

OCT 11 : Filed I-751

NOV 11 : Received I-797 Notice of Action.(It says I-751 receipt notice...1 year extended)

NOV 11 : CHECK_$590 cashed.

DEC 11 : Done Bio.

JAN 12 : Resident card date is expired.

did you sent the original pay stubs for recent 6 months and W2 or just the copies?

Initially I've sent W2(copy) and all the tax return papers and I-864 etc. And I'm sending copy of the pay stubs, not the originals with RFE.
