Hi All

I had been to the DMV here in Manhattan and i had my ssn I-94 & passport

I -94 is valid till Sept. The lady there said she would need a document or EAD card showing 1 year validity for the exchange of my canadian licence.. :crying:

Now even if i recive my EAD which will be valid for a year but when i recieve it from USCIS and go to DMV it would be probably short by 15days or so.. :unsure:

Is there any other place in NY where they would do without hassle jus with I-94 and passport

Also tht SSN card which i recd say on the Top "VALID WITH WORK AUTHORISATION"

Is this same for everyone or only K1

APPROVED, given a 1 year stamp - told the card would be mailed right away :)

Rec'd 2yr conditional GC 10 days after interview :)

All states are coming into compliance with the federal REAL-ID Act. They cannot issue you a license that would also be valid for federal purposes unless they verify that you are here legally. They wil only issue a license for the period that they can verify that you are here legally. If you have a I94 that sez that your legal stay expires in Sept, then they can only issue you a license valid until Sept.....apparently they do not want to do this and need a valid stay of a year or longer.

When you bring them a EAD that is valid for a year, they will issue you a license that is valid for a year.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

In Pennsylvania the DMV only require proof that you have applied for AOS (along with a SSN) to get a drivers license, and will issue you a DL valid for 1 year from the date you went to the DMV, not the date of the AOS.

I know this because I renewed my PA DL this way on Tuesday.

I should note that by not accepting proof of AOS (i.e. the NOA1) as proof of legal presence, NY are NOT meeting the requirements of the Real ID act.

I traded in my Canadian license for NY one using my EAD. EAD was only good for one year so my driver's license had nice red letters on it "TEMPORARY VISITOR EXPIRES (1 year expiration date)". So now one year later I have to go back to DMV and renew. Such a pain. They'll probably renew it for 2 years this time since I only have the 2 year conditional green card.

NY requires the 6 points of identification - going by the chart on DMV website I couldn't come up with 6 points before I got my EAD. So I just waited and didn't try to get one with just I-94 and passport. I don't have a car to drive so it wasn't a big deal for me.

I was successful in Manhattan asking to speak with a supervisor and providing a copy of my marriage certificate, NOA for AOS, passport, canadian driver's license and SSN. They took my Canadian license and issued me a drivers license valid for one year.

Another thing, I don't think the DMV on 34th street near the Blimpie's will do an out of state (Canada) license transfer. Check the NY state DMV website for more details.

I tried the one at Herald Square, and it had a huge line, so I went to the one near Battery park, and it worked out great (remember to ask for the supervisor).

11/28/08 - InfoPass appointment to get I-551 stamp in passport to extend residency for another year

a kind of related question, you mentioned " exchange of drivers license" does that mean in NY state you dont have to do a theory / pratical test..but just change your license over??? or is that soemthing only for Canadians?

Hello

We are having the same problem in NC. Initial I-94 is invalid now since we are married. Although my Canadian wife was issued a valid driver's license a few months ago, it expired today based on the initial 6 month period from issuance of her K1 visa. They won't issue another one to her until her adjustment of status goes through. Which means she can't drive for another 8 months plus. She has a US military ID in her married name, a US social security card in her maiden name, and all of her Canadian ID. Talked to a supervisor at the main office in Raleigh and they said she should be able to be issued a driver's license without any problems...but that obviously wasn't the case even though the Real ID Act 2005 states otherwise. Damn the DMV!

Only for canadians and out of state licenses as far as I know.

Now that you have a greencard, they will remove the "Temp visitor expires.." notation from your license. In fact, you can get this done as soon as you receive your greencard, no need to wait till the license is about to expire.

Coming from Australia, you have to get your learners permit (pass written test), attend pre-licensing course (1 day), then with that pre-licensing course certificate you can go for your road test. When you successfully complete the road test, you will probably have to hand over your Aussie license, which they will destroy after 60 days unless you tell them not to.

What? No - the DMV won't take your foriegn license. They have no right to. If you come from a different state, they will take the license from your old state, because I believe its not allowed to hold drivers licenses from different states at once, but there's no such rule about having a foriegn license.

We are having the same problem in NC with the driver license, they don't want to give her a driver license with anything but the Aug. 6th visa expire date as originally listed when a learner's permit was issued. It seems they just assume the same dates. Big difference though, for the learner's permit, Jum was not married, and now we are married but the local office just wants to see a permanent residency card and told us to go to the INS, of course, that government office no longer exists as we all know. But I would really like to talk to you to see what path you took. I am in Charlotte, but if I have to do some calling or driving around, I can do it.

We are having the same problem in NC with the driver license, they don't want to give her a driver license with anything but the Aug. 6th visa expire date as originally listed when a learner's permit was issued.

Even in my state (Pa) you need at least to have filed AOS to get a drivers license past your Visa. You might still be able to get a license after you filed AOS and get back NOA1.

Yes they will take your foreign license. At least they are supposed to. It's against the law to posess more than one driver's license.
