Hey guys I need your help and I am not sure what to do. We are getting married on November 23rd and then will file for adjustment of status. We planned on filing everything at once but we have an issue that I am not sure how to deal with. My dad was admitted to ICU last night. He has heart problems and went through a triple bypass a few years ago. He hasn't been feeling well ever since. I feel like I should be home but right now he is stable. I know if I go now, I can't come back. My I-94 is stamped for multiple entries, which obviously was a mistake and I wouldn't want to take the chance. Our Vegas wedding is already booked and paid for so we are hoping nothing happens between now and then. So once we get back do you guys think I should just apply as normal and hope for the best, or should I apply for my advance parole separate and see if I can get it processed quicker due to circumstances...or is that even an option. I feel so bad I am not there with my family now. It was hard enough on them when I came here. What are your thoughts?

I'm sorry to hear about your situation, and hope your dad feels better soon. I think you have two options:

  1. Leave the U.S. now to be with your family and start the process over again
  2. Get married ASAP, and file for AOS ASAP, and then make an InfoPass appt to request an expedited AP.
Neither choice is ideal, obviously. Best of luck.

I'm sorry to hear about your situation, and hope your dad feels better soon. I think you have two options:

  1. Leave the U.S. now to be with your family and start the process over again
  2. Get married ASAP, and file for AOS ASAP, and then make an InfoPass appt to request an expedited AP.

:thumbs: As of now you have little choice but to file the AOS and then file an emergency AP. You could make an infopass appointment at check with the local office who are usually pretty understanding, hoiwever without being married and filing for AOS you have no status to protect with an AP, but see what they say. In the case of an emergency AP you can file at the local office and GO, they will send the AP to a foreign consulate if so desired OR they can send it to your husband who can forward it to you.

Your K-1 is NOT valid for multiple entries, trying to capitalize on a CBP mistake is not a good idea. They will say, "we made an error...too bad for you"

Without a filed I-485 a K-1 entrant is not eligible for advance parole.... It is my understanding that the I-485 must be filed and receipt of the filing in hand before the local USCIS can consider an expedited decision on AP.
