Hi guys how are u?? I have a question my husband came in on Seprt the 30th by JFK, he got the EAD stamp, it expires on Dec 29th. Thanks God he just got a part time job, my question if is he has to quit when the Ead expires or he can keep his job. We are going to send next week the Aos papers, he came through a K-1 visa.

He will, unless the 1 year EAD comes through before December 29th. Takes 60-90 days, so you might be cutting it a little fine timewise. It does sometimes come through in less time than that, but that's what the general advice is.

I'm surprised he got a temp EAD at JFK. I thought they'd stopped issuing these on 1 June this year.

No, Nik has the stamp on his I94 too.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Technically, he is not legally able to work now nor has ever been. K1s are only eligible to work with an EAD CARD or a Green Card.

I don't understand the logic of that. Why give an EAD stamp that states you're entitled to work temporarily for the duration of your I94's validity, if it isn't legal to work on it?

I share your bewilderment, but this wouldn't be the first time the government has done something that doesn't make any sense. Have a look at the pinned topic in the "Working and traveling" forum for more specific info on this issue.

I should also mention that there are a handful of other threads that expand on the pinned thread, but I'm too lazy right now to look them up after they didn't turn up at the top of a recent search attempt. I know they exist because I participated in a few.

Up until this spring there was a provision in the I-9 form that new employees fill out to show their work eligibility which would let someone with such a stamp work. They changed the I-9 this spring, and that "loop hole" closed.

No, you are 100% wrong. I sincerely wish I had a "banging-head-on-the-wall" emoticon to use. You have obviously not read any of the recent information on this topic, or the pinned thread I mentioned, or any of the many threads on VJ that cover this. I encourage you to read up on this before offering any more incorrect advice.

I guess I never realized that you ever needed an EAD or GC to APPLY for a job. Applying for a job is quite different than working at a job.

:lol: I suppose in this case Zen Den is correct - no EAD or GC needed to apply for a job as far as I know, though I suspect applying for a job that one cannot yet legally hold is not the best use of one's time.

Unless one needs interview experience (US style). It took my wife a couple of interviews before she was comfortable enough. She would have preferred the failed interviews to have been at positions she was not interested in.
