My fiance got  his visa last week and we have been making plans for the upcoming months. He currently has a job, and trying to save some money before he comes here. So he had been planning on staying there for another few months. 

Would it be possible to keep his current employment (he can work from home) when he comes to the USA? His salary would still be deposited in europe etc. If he can do that then he could come to the US earlier than planned.

In my case, I was told I could. Your fiancé's situation seems similar to mine, although I am self-employed. I work from home through the internet. Get paid in my home country by canadian cies. I dont know if the fact that he is employed by a company would make a difference.

Although not everybody will agree, I was told from a reliable source that it is legal to do so, because it does not constitute employment in the US.

Many people here have also told me they did it after arriving on the K1 and it was fine. They openly admitted at the AOS interview that they had "worked abroad" before getting the EAD and it did not cause any trouble.

I dont have any hard facts to back this up, but I do trust the sources I got that info from. ... and it makes sense to me.

AOS appt: 2011-05-12 (notice sent April 6) APPROVED :)
