November 2009 K1 CSC Filers

Here's my update - received a letter from the NVC on 3/15 that they had received and approved our I129F from USCIS and would be forwarding it to the embassy in Nassau (Bahamas). Got a call today from the Nassau embassy telling me they had received our file. She asked for an email address for my fiance (beneficiary) and verified mine. She said she would be emailing us some information and forms because there would be paperwork, a medical interview, etc. She asked why he's in the Bahamas (he's Canadian) and I explained that he's here for school. She asked when he would be done with school here and I told her the end of August. She gave me her name and phone # in case we had any questions. Exciting! Hopefully we can take our time a little bit to gather all the stuff we need to send it before they schedule an interview, because we have a trip planned to the US at the end of April between semesters to do wedding planning and see my family.

1997 -- Met online and kept in touch over the years

10/06/2007 -- FINALLY met in person (he came to see me, first visit was 10 days!)

11/16/2007 -- His 2nd visit (3 days)

12/18/2007 -- His 3rd visit (20 days- he met my family at Christmas and I met his family in Vegas for New Year's Eve)

More visits by him in January, February, March, and April

I visited him the first time in February for Valentine's Day (and another visit by me in March)

04/15/2008 -- Sold my house and moved to Canada with him

05/01/2009 -- Moved to Caribbean together while he attends med school

10/10/2009 -- Engaged!!!

11/28/2009 -- FedEx'd 129F to CSC

11/30/2009 -- FedEx package received by CSC (per tracking)

12/01/2009 -- I-129F NOA1

02/19/2010 -- I-129F NOA2 (took 80 days)

03/15/2010 -- Letter from NVC that they received and approved file. Forwarding it to Nassau embassy.

03/17/2010 -- Phone call from Nassau Embassy. Received file and will be emailing info and forms.

While I am happy about everyone else's progress on Packet 3, medical exams, etc., is there anyone on this forum like me that filed in November and is still waiting on their NOA2?

I filed Nov 23rd, got a touch on Nov 26th, and nothing since. Next week will make it four months and while I am trying to adopt a Zen attitude about this whole process it is starting to get a little scary. I feel like I'm the only VisaJourney November filer that hasn't had my application touched since November. Someone posted on this forum before how they basically lost his app - after five months he called and they said it had "timed out" and he had to start all over again - very scary stuff:(

Mike,

It might be worth your time to try and call the CSC.. Clearly California is out of whack.. As you can see from other's timelines they are processing Jan & Feb filers at this point and may have somehow misplaced your application..

It might be worth your time to try and call the CSC.. Clearly California is out of whack.. As you can see from other's timelines they are processing Jan & Feb filers at this point and may have somehow misplaced your application..

Thanks for the suggestion Jared. After reading your post, I decided that although I didn't expect them to help me at all until the five months was up, it couldn't hurt so I would give the USCIS a call anyway. I called the number and went through a bunch of menus (the automated menu basically said not to bother them if it had been less than five months). However, I was eventually able to reach a real person. I explained the situation, that other people had been getting approved that had filed in December and January and I just wanted to make sure I didn't slip through the cracks.

The USCIS representative was very courteous and at one point she told me she could tell me exactly how much longer my application would take (I was a bit chagrined at this); then she proceeded to tell me I had 35 days left before it would be approved - if after 35 days, (which brings me to the five month mark), it wasn't approved I could call them back and they would "refer the case" for processing or something like that.

This was pretty much the pat answer I was expecting but at least I can say I gave it a shot (and I know she was able to access the case on her computer and did not see any problems). Meanwhile I just started a 30-day diet of no meat and no alchohol in hopes that my sacrifice will be noted and Buddha, God, or any higher power that can help will hurry this process along:)

Same here!

this is our timeline:

9-2008 sent in petition and got NOA1 (never heard anything)

1 bis 3-2009 called USCIS (once every week, but never got a concrete answer)

4-2009 got congressman involved (we got Info that Petition was approved and sent to NVC but we never got a NOA2)

5-2009 got letter from USCIS saying NVC sent the petition back to USCIS for review (called to ask for more info but didn´t get an answer)

9-2009 received letter from USCIS saying the case expiered and we would have to file a new petition

10-2009 contacted a lawyer to file a second petition

11-2009 sent in petition and got NOA1

since November NOTHING!

Now we´re planning to live in Germany because we don´t think we will ever get a response. Though we would really like to know what the problem is!

I'm curious - did they have the hubris to ask you to pay the filing fee all over again? Did they refund your $455 from the first time you filed? I admire your patience and pesistence.

Ummm, well YES of course we had to pay the filing fee again! And honestly, there is not a lot of patience left in our systems and we both just wanna FREAK OUT! :angry:

:rofl: Never mind....it´s the German part of us writing here (as you could tell of the way of the written English probably :P ) and I wouldn´t even "see" your bad spelling anyway ;)

Hi dev23j,

We got approved on the 2nd of March ,and finally found out from NVC yest i.e the 10th that they had got our package.So roughly little over a week for us,but for some others it was faster,so keep calling everyday this week and the next, your's will be on its way.

And when you call,you just chose to directly speak to an operator ,and give them your receipt number mentioned in the NOA2,that's what my fiance did.

I am in the same boat as you. NVC approved on March 4th and sent to Delhi Embassy. I am still waiting on packet 3. I got confirmation email that they have emailed packet 3 to my fiance. Did you get your packet 3 yet?

Glad things are picking up pace for you :) But I never got any confirmation email from the Mumbai embassy,I called them yest and the lady I spoke to,took my case number and told me that they had mailed out the packet 3 yest.So I am just waiting very restlessly for that.

So i got a email from the embassy last night stating that if i have not received packet 3 yet, my fiance can go to the US embassy site for new delhi and download the forms for packet 3 and fill them out / scan and then email them to move things further along. I will fill out the forms today and email them over so they can shoot out Packet 4 / Medical / Interview dates.

Any luck on your packet 3? My fiance has NOT received anything as of Friday night in New Delhi. Might come Saturday or Monday i hope. But in the mean time this is the response i got back from the embassy yesterday regarding packet 3.

So i got a email from the embassy last night stating that if i have not received packet 3 yet, my fiance can go to the US embassy site for new delhi and download the forms for packet 3 and fill them out / scan and then email them to move things further along. Hi,

I sent a email to the embassy to verify what email address and who the email should address to. I assume i will hear back Sunday night California time. Once i hear back i will post the info up. Also once you send/email packet 3 .. they will also send you a appointment date via email if you like.. so you can according book tickets for your fiance to come to the USA etc.

We are getting close to the final step :)

Anwesha,

From what I know, in some embassies/consulates they only enter new petitions/data on certain days (i.e. Friday) so maybe that is the reason?

You know more about it from regional boards, I am just trying to find something comforting to say...

Like, Kiev, enters their received petitions once in a blue moon. "Every" Friday they say, but they don't do it every Friday.

I believe you will hear something back very soon!
