November 2009 K1 CSC Filers

Timeline

NOA2 on Feb 19, 2009. Hope to hear from NVC soon!

Does anyone know if once you are approved for the K1 visa you can enter the US as a visitor, leave, and then come back in and give them your K1 and start the 90 day clock? Or once you're approved for K1 do you have to enter the next time as K1 no matter what?

We're planning to get married in August.. we're both outside of the states now (Bahamas) and before we get married we may have to go to Canada first.. the problem is where we're flying from we would have to go thru the states first (no direct flights).. so as an example could we fly from here to say Atlanta, he enters US there at the airport (but is in transit to Canada), we fly to Canada then drive into the states and at the border he gives them his K1 envelope. Any ideas? We're trying to figure out how to plan our travel in August since we need to bring his car here.

1997 -- Met online and kept in touch over the years

10/06/2007 -- FINALLY met in person (he came to see me, first visit was 10 days!)

11/16/2007 -- His 2nd visit (3 days)

12/18/2007 -- His 3rd visit (20 days- he met my family at Christmas and I met his family in Vegas for New Year's Eve)

More visits by him in January, February, March, and April

I visited him the first time in February for Valentine's Day (and another visit by me in March)

04/15/2008 -- Sold my house and moved to Canada with him

05/01/2009 -- Moved to Caribbean together while he attends med school

10/10/2009 -- Engaged!!!

11/28/2009 -- FedEx'd 129F to CSC

11/30/2009 -- FedEx package received by CSC (per tracking)

12/01/2009 -- I-129F NOA1

02/19/2010 -- I-129F NOA2 (took 80 days)

03/15/2010 -- Letter from NVC that they received and approved file. Forwarding it to Nassau embassy.

03/17/2010 -- Phone call from Nassau Embassy. Received file and will be emailing info and forms.

This is what I know based on what Ive read on the USCIS website and the VJ forums:

While the K-1 visa is being processed the beneficiary can enter and leave the US as usual. However, after the K-1 visa is approved and you have your envelope for the POE, once you enter the US that's it, you are in. You can't leave the States unless you have an Advance Parole. IF they find out the Beneficiary of the K-1 entered and exit the US he / she can be deported and you'd have to start the process all over again. That's why when people go to Caribbean for they honeymoon the number one advice is: "make sure you dont set foot outside the US. Dont to go the British Virgin Islands. Dont do anything that will make the USCIS think that you left the States even for a second".

Coming from the Bahamas you'd have to go thru US Customs at some point. I don't know if Bahamas is like Toronto, where you go thru Customs in Toronto and the flight is treated as a US domestic flight. Point is, they'll know you and your fiance(e) are in the States. I don't know how much information the Immigration Officer at border can access. I've crossed the Canadian border a few times since Dan and I started the K-1 process and we always get questioned about our relationship (I think it's more out of curiosty than anything else. How a girl from California ended up dating a guy from Hamilton). Only once a US Officer asked if I was moving to Canada and I replied "No, we are doing a K-1 Visa". Don't know if it was a "trick" question or if she couldnt see that we were in the process of getting the K-1. Once it's approved they may be able to see he / she is a K-1 visa holder and ask for the POE package.

Whichever the case, it's been such a long painful journey, why risk it? Maybe plan things so you can go to Canada before the visa gets approved, do whatever you have to do there, drive down once it's approved and let that be your POE. :)

They'll send the NOA2 in the mail and the approved I-129F to the NVC. The NVC will in turn send it to the embassy. I got a letter from the NVC about 10 days after the I-129F was approved saying they'd be sending the package to Montreal within the next week. The letter has the NVC case number. I suggest you wait for the NVC letter so you can have your case # on hand but, you dont have to. You can call the NVC and ask about the status even tho they suggest you wait at least a week. :dance:

I' m confused on how to track our case from now on. Should we contact the NVC tomorrow or somewhere next week ? By email ? Or calling ? How will we know our application arrived in Ljubljana ? I don' t wanna call the embassy too many times . . . :blush:

Oh, I see ! I also heard and read some people never received a NVC letter ( while the case was already sent to the embassy ) . :blush:

OK Now, just wait for a week and call them. the trick is.. hit redial multiple times and u will get through. u have hit some numbers and when u get the person... give your case.. petitioner name and birth date... benefiiciar and birth date.
