hi guys.Just want to ask some question regarding Adjustment of Status. I got here in US:

Date of Entry: Oct.8,2008

Married : Oct. 11,2008

We wanted to file AOS as soon as posible but due to economic crisis, my husband is one of those people who got laid off from work after 2 months we got married.He got new job after four months then got laid off again.In short financially we aren't able to file.My question is : Is there any time frame to apply AOS? We are married for a year now,does anyone have the same situation as we do? Thank you very much I do appreciate some response. God bless

believe or not, the uscis says that people should file for AOS right away after getting married but they don't really indicate a limit as far as months, so it's alright that you apply whenever you can. the only risk is if you get into a situation where your status has to be checked 9ex, you and your husband are together and he's driving and he is pulled over and for some reason a cop asks for your valid IDs too and then discovers that you don't have a valid status (out of status actually), then that's when you get in trouble.

so as soon as you are able to financially afford it, apply for AOS

The answer is:

You are supposed to have filed it long ago - most people will tell you, and I tend to agree, that you should have filed it before your I-94 expired (which was 90-days after you entered the US. Which for you, was some where in January 2009). You didn't do that but you still can. Are you in trouble? Not at the moment so the sooner you file it, the better things will be. :thumbs:

ty for reply,i got my state id though.lol.but yeah i know what you mean.We are planning to file asap,we got the money but no permanent address. we're planning to move as soon as my husband get his new job then we will file. your baby is so cute..

Just know that if your AOS is denied, you've been "out of status" over a year now and that could mean the 10 year ban could be imposed.

Couldn't scrape up $1010 during the course of the year? Maybe this is not a good idea for you two, until he can get his feet underneath him.
