Hi guys.Just want to ask some question regarding Adjustment of Status. I got here in US:

Date of Entry: Oct.8,2008

Married : Oct. 11,2008

We wanted to file AOS as soon as posible but due to economic crisis, my husband is one of those people who got laid off from work after 2 months we got married.He got new job after four months then got laid off again.In short financially we aren't able to file.My question is : Is there any time frame to apply AOS? We are married for a year now,does anyone have the same situation as we do? Thank you very much I do appreciate some response. God bless

You don't have much choice but to file as soon as possible. You've married within the 90-day limit (from your arrival to the US) which is a good thing.

The steps you follow now are the same as you would had you filed a year or so ago. The Adjustment of Status Guide (K1 & K3 Visa Holders) has the relevant information you can follow.

Apply ASAP, borrow money from friends / family or try and get a loan. Do what you can and apply right away.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hi Karin

You gave me some good advice a while ago and I have another question, how did you get your Green Card without an interview, is that usual? I just received my EAD card what will happen next? Thanks for your help!

If your AOS is transfered to CSC its very likely you will have no interview, there is however a small chance it could be sent back to local USCIS for an interview if CSC feels it is needed.
