Ok.. I have a quick question.. I have to use a co-sponsor to help me in getting my fiance here and his 2008 tax returns have 3 children on it who he is no longer responsible for.. Therefore I am getting a letter from the childrens mother stating he is no longer responsible.. Ok what I am needing to know is what does that paper need to say? How should we lay it out to show to the consulate? Also on the I-134 Question #10 it says date submitted.. Do I put the date I submitted the I-129F or the date my fiance will go to his interview? Any help is appreciated!

The ex-spouse's letter may not make a difference.

Some consulates apply the guidelines from the I-864 affidavit of support (page 7) to an I-134 submitted with a K visa petition. With regard to the sponsor's children and household size it says:

Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns.

You must include each and every person whom you have claimed as a dependent on your most recent Federal income tax return, even if that person is not related to you. Even if you are not legally obligated to support that person, you must include the person if in fact you did support that person and claimed the person as a dependent.

You may want to check in the MENA regional forum to get Casa specific feedback.

In my opinion it would be better to find a co-sponsor that can qualify more easily.

The co sponsor was only taking care of his step daughters children bc she was having some issues.. I was told previously that I can get a letter from her stating that she has the children now... Am I wrong in that then?
