My husband's I-751 has just been approved and the notice stated that he should receive his new green card in a couple of weeks. So now what? A green card doesn't mean he's a U.S. citizen. What do we do next in order to get him his citizenship? Is there a waiting period to file other documentation for this after the conditions have been removed via the I-751 filing? Also, he has family members he's wanting to get residency for. They are in the U.S. illegally. Can he do this with his green card or does he have to wait for actual citizenship? Any information will help!!TIA

AOS Timeline

  • September 29th, 2012 - Mailed AOS packages for Mother and Father-in-law (sent via UPS 2nd Day Air; Chicago P.O. Box)
  • October 2nd, 2012 - Confirmation of Receipt from UPS
  • October 5th, 2012 - Checks cashed
  • October 10th, 2012 - NOAs for all six applications
  • November 5th, 2012 - RFE received
  • November 9th, 2012 - Additional evidence sent to immigration
  • November 13th, 2012 - Notice of RFE received
    Waiting...waiting...waiting...

Not a citizen, no - a LPR - new card will be valid for 10 years.

Citizenship is of course not required but if he choses to seek it, he can apply for it as soon as 90-days before his 3 year anniversary date of his residency (Residence Since date on either his old or new card is the start date). This is of course IF he is still married to the US Citizen who's marriage-to his residency is based on.

He will have to wait until he's a US citizen so he can file for them. You can check this information in the instructions for form I-130 and also see how long it may take in the Visa Bulletin from the DOS.

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Why? The more posts the more responses...the more responses the more knowledge...the more knowledge the better equipped I am to get things done correctly and quickly! Oh well....

Not necessarily - usually one forum/thread is enough.

You don't get more responses in more threads - it just gets lost and people end up duplicating information or ignoring all of the threads because they won't take them seriously, and the moderators receive reports about unnecessary duplicated threads which we then have to go and close. So, if you wish for the most efficient method of getting the correct information, you post in the correct forum and and don't spread the same question over a number of places.

Agreed!!!! There is a member out there with about a million and one open threads... I don't even open her threads anymore. She asks questions multiple times and often could very easily read the posts on the first two pages to get the answers herself.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

by illegally do you mean "overstay" or entered without inspection?
