K3 visa in hand, now a bit confused on everything else

Timeline

Hi, I am very pleased to say that after extensive waiting on the embassy in London.... I finally have my wife here in California.

Yet now that she is here, I am not sure which forms I need to fill out next. Especially pertaining to 1-ability to work, and 2-social security card (this is especially important because we can't sign her up for health insurance without one)

Anyone out there with some experience and/or knowledge on this, I would love to hear from you.

Something else, we have already had the I-130 approved and have just recieved a letter saying that I need to send in another $70 for the affidavid of support. Do I need to do this if we just send in an adjustment of status application? As you can see, I am getting myself a bit confused here. And what does EAD stand for? I know it is to work, but I don't know what the acronym stands for. and I don't know what I need to do to apply for it.

Do you absolutely plan to NOT go back to the home country for an Immigrant Visa? Have you checked to see if that is faster/not than AOS?

Right now she can't work or have a SS#. If she wants a SS#, she has to be employment authorized to get one. If she wants to be employment authorized, she can get that by applying for an EAD/Employment Authorization Document. (apply via form I-765---see the Guides here at VJ please)

Get on the horn with the insurance people and explain your situation, or substitute privacy as a good argument. Many insurance co's will take a different identifying number if you don't want to use your SS#.

I got medical insurance without a SSN. Maybe you should pursue this harder?

*th May 2003 - Entered US

4 July - Married in US

* Aug - Returned to UK

25 Aug - I-129 NOA 1 Missouri

* Sep - Returned to California while K3 pending!

19 Nov - I-129 Approval Online

25 Nov - posted application for Police Certificate

3 Dec - K3 application sent to London Embassy

13 Dec - Packet 3 arrived!

4 Jan 2004 - Receipt for Police Certificate application arrived, dated 1 Dec, accompanying letter says it's taking 40 days from date of receipt.

6 Jan Police Certificate arrived in US

6 Jan - Packet 3 and checklist sent next day delivery to Embassy.

7 Jan - called Embassy, told 2 wks to be put on the system and 2-4 wks before interview.

8 Jan - called again, told 12 wks before likely interview.

9 Jan - Emailed Embassy, asking about application and informing I was available for interview at short notice.

10 Jan - Letter received from Embassy with interview date of 20 Jan.

20 Jan - Medical and Interview at Embassy - K3 Visa Issued

24 Jan - POE LA!!

25 June - I-130 approved

19 Novr - EAD NOA Notice Date, received 23rd Nov

27 Nov - EAD Biometrics Appointment

2 Feb 05 - EAD approved online

7 Feb - 2nd Approval email

9 Feb - applied for SSN at SS office

16 Feb - SSN received

* June - Sent in AOS application

29 June Received I-797C NOA directing me to make biometrics appointment

27 Sep - AOS Biometrics Appointment

28 Nov - AOS interview letter arrived

You need to get an EAD before applying for a SSN. My lawyer told me to fill out form I-765 and then make an appointment on-line at the INFOPASS website. He said if you go apply in person, you get an EAD in 1 day. He said do not mail it, go directly to the office. Once you have your EAD you just mail in an application for you SSN and it should come in 3 weeks.

I thought there was a 90 day wait for EAD?

Started our visa journey Jan 06.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

EAD=employment authourisation document!!=$170

it is a very good idea to weigh up the 2 options & to see which is best for you, options being, AOS or returning to London as i am for CR1/IR1 interview!!( which is also a realy good excuse for a holiday ) :P

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

There is. But CG's lawyer has told her differently.

K-3s should also know that the EAD approval does not seem to automatically generate the change in status in the SAVE system that allows SSA to seamlessly issue a Social Security card. So that will not automatically come in 3 weeks either.

Look for posts from mdyoung on how to best manage a SS-5 after getting an EAD.

Hi!

I came to the U.S. with a K3 visa too. When I arrived my I-130 had not been approved yet, so I could not apply for Adjustment of Status yet. But I could apply and receive with no problem an EAD (Employment Authorization Document) and Social Security Number.

So to answer your question, send in the money for the Affidavit (regarding form 1-130) and at the same time apply for Adjustment of Status ( I-485) and for EAD (I-765) once you have EAD you can go and get a social security number.....it took me a little less than three months to get my EAD
