2 Questions Regarding K-1 Interview

My fiancee will be going to the Kiev consulate for her interview. I read the Kiev Consulate website and I have 2 questions:

1) it indicates that NVC will issue an "appointment letter". The word "appointment" is confusing to me. Is this simply a document that she must bring to her interview at the Kiev consulate, or does this document actually have her interview appointment on it?

2) They show on VJ several forms for the K-1, but I see no reference to these forms on the Consulate website regarding what is needed for the interview. These forms are DS-156, DS-156K, DS-157, DS-158 and DS-230. The title on these forms indicate that they are for "non-immigrant" visa applicants. I would think my fiance is an "immigrant" visa applicant. What is the story with these forms and are any of these necessary for my fiance to bring to the interview?

1. No. The appointmetn will be made with the call center. Kiev consulate will send and you MIGHT receive a letter called "packet 4". You do not need it. If it never arrives...no problem

2. K-1 fiancee is non-immigrant. Kiev uses DS-156 and DS-156K for fiancee visas. They use DS-157 for males over age 16 ONLY, not for anyone else. They do not use DS-230. Various consulates use various forms, but Kiev uses only those TWO for a female K-1 applicant.

Even though the K-1 is non-immigrant, Kiev handles them through the immigrant visa section, which is good news for you and you will see why. The immigrant section has 6 or so applicants everyday vs. the 300 or so for non-immigrant section.

So I can just ignore where it says on the Kiev website that I need an appointment letter? It is interesting that my fiancee is considered a non-immigrant though she is seeking become an immigrant. It says, on the Kiev website, that non-immigrant visas are for tourists, students and for work so your answer clears up the apparent conflicting information.

The K1 is a strange animal. It is actually a 90 single entry visitors visa ( non immigrant because if the couple doesn't get married the visa holder MUST leave) The marriage and the visa grants automatic approval to file an adjustment of status and stay.

This will not be over quickly. You will not enjoy this.

Yes, ignore that. Ukraine mail is so poor, we never received the packet 3 or packet 4. We still have the same flat in Donetsk and it has yet to arrive...I am beginning to think it never will. :lol:

When you call for the appointment, they will give you a confirmation "invitation" number. That is all you need, and actually you don't even need that f they do their job and they usually do. Your fiancee will just show her passport to the people outside and she should be on the list for that day. The forms and instructions are available online at the consulate website. So you really do not need anything from them.

K-1 VISAs are non-immigrant because the visa itself does not allow anything except one entry and a 90 day stay. The AOS is what grants the right to be a permanent resident. All K visas are "non-immigrant" but are unofficially considered "dual intent", whatever that means. Basically it means a visa from which adjustment is allowed, adjustment is not allowed from a tourist visa, for example. But the VISA itself is non-immigrant.

An immigrant visa, such as the CR-1, requires more work up front, before issuance and no AOS after arrival.

Your assessment of the visa is correct. However it is in no way "automatic" that the AOS will be approved. It is a separate process entirely, followed in two years by a definitely NOT automatic lifting of conditions. Nothing in this process is automatice or to be "taken for granted"

the amrriage grants a marriage, that is all. The mariage is legal and matrimonial responsibilities are entirely separate from the immigration process. Your green card can be refused by USCIS...but that is not a divorce. Your wife my be required to leave, but you are still married! Marriage and a K-1 grant the abiltiy to APPLY for AOS, they do not guarantee a successful AOS.

My fiance is going to Interview in mid december and here are few questions

1- DS - 230 not required?

2- i-601 . She was denied tourist visa few years back and there is a need to file I-601. Anyone dealt with it? There wasn't any mention of submitting form I-601 on her behalf, but we want to be ready . Any suggestions?

3- Evidence of engagement. What to write in DS -156K under this question ? There wasn't ring or anything. I just asked her to marry me . We met few times during last 6 months on different occasions and I met her family as well she met mine. Have photos , receipts, etc. But there is no ring or receipt for it Any suggestions?

4- Medical exams. Any statue of limitations ? 1 month in advance is ok? Do they require translation of vaccination records from local clinic?

VSCvictim...I see you have finally started your own thread for this question(s) and that is good. adding your questions to existing threads (especially pinned topics) is a very poor way to get answers to your questions. Also you need to listy your fiancee's country in your profile so your threads get listed in the Ukraine portal where other Ukraine members will see it when they sign on. I mean the general forums are fine, but directing it to the country portal will get you specific answers for your consulate and that is what you need.

Just enter the country of your fiancee. Then close out VJ and re-open it. Any changes you make show up the next time you open VJ
