Should I submit 1099 with I-864EZ if I'm only using job income?

So I'm assembling the I-864EZ package now and noticed that it says to submit "each and every Form 1099, Schedule, and any other evidence of reported income."

I'm using the EZ form specifically because I'm using my salary alone to meet the income requirements. I do have a 1099 due to some rental properties, but I'm not counting any of those for my income. Although, they will show up on my most recent tax return, so should I go ahead and submit the 1099 too? My fear is that they'll see that, and I'll get an RFE (not a big deal, I know) for more information concerning the rentals.

This is my final checklist that I'm submitting with the I-864EZ package assuming I should submit the 1099.

1. Receipt showing AOS fee “PAID” on October 27, 2009.

2. Form I-864EZ, Affidavit of Support.

3. Letter of Employment from current employer.

4. W-2’s for 2008 Tax Year.

5. 1099-Miscllaneous Income for 2008 Tax Year.

6. Federal Tax Return for 2008 Tax Year.

7. Weekly Pay Stubs for the past 6 months (28 total).

What does everyone think? My gut says to include it :).

Include everything - it is better to send more than they need.

^^Agreed, the more the better. Also keep in mind that if you do not interview in Montreal until spring (which unfortunately may be the case since they are moving at a snail's pace lately) you will need the 2009 return by then. We finished NVC in Feb/09 and submitted 2005, 2006 and 2007 transcripts. At the interview in May/09 all they were interested in was the 2008 return. Good luck. :thumbs:

All that is actually required is your I-864 and your 2008 tax return, to send to NVC - you can send all that other stuff if you like, but it's not required - the only reason someone would possibly send all of that is if you are skating very close to the 125% - in which case it might help.

A complete tax return includes any W2 and/or 1099 forms. You'll be sending at least one complete tax return. Including recent pay stubs is a good idea but more recent ones should be carried to the interview.
