immigration lost my paper

hi i came to america in CR-1 , I AM MARRIED AND HAVE A BEAUTIFULL SON .

IN october-25-2008 ,we send my I-751 to remove the condition on residence i think (GC FOR 10 YEARS)

i went for fingerpint in 2009 and we sent all needed information in time i have all the proof but the immigration lost my paper and the sent a letter that they said because i didnt sent any paper the petition is denied ........

NOW we sent service motion to reopen with all the proof before 3 weeks and i am still waiting any advice? plz.

There's no way to remotely advise you when we can't tell what 'paper' they've lost. You'll have to be more specific. Did they send you a request for further evidence which they're now saying they never received?

There's no way to remotely advise you when we can't tell what 'paper' they've lost. You'll have to be more specific. Did they send you a request for further evidence which they're now saying they never received?

if they sent u an RFE , then u may need to send again the whole package or what they indicated

if the letter state that you r denied as u didnt fill in the window time (the 90 days ) , and u have ur NOA , then make a copy of it and (a copy of ur package , hopefully u made one ) and re-send again with the letter u received from them to inform tht u already sent in time and the copy +NOA should be ur evidence tht u did so ...

there is ALOT of IF ,,so please be more specific with ur situation to help u better

The OP already stated that he's (or we - whoever 'we' is) sent in a motion to reopen. Resending the entire package again is irrelevant at this point.

I was just trying to figure out why he was denied in the first place.

sorry i dont speack english to much i am from lebanon , IN May 28 2009 USCIS issued a request for evidence , providing you with 42 days in wich to respond . IN june 2009 we sent papers (froof for my marriage,assest biirth certificate for baby, driver lisence ......)andthe immigration lost those paper i have the reciept and sent to me (notice of decision) we changed the adress and they knew that but they sent the decision in the old adress and when we rent our new appartement we sent (change of adress ) they refuse to renew my gc bacause they think i didnt sent any file but we have all the proof we sent the paper in 29 june 2009 ,10 days prior to the deadline . the records were lost at immigration office and we have the reciept from the post office .i hope i can explan more thank you.

Timeline

This is a good example of why it's very important to get signature confirmation from the postal service and it's a good thing that you did so, roula. Here is what I would have sent (along with a cover letter explaining your situation and pointing out USCIS' administrative error):

Copy of RFE

Copy of everything that you sent in response to RFE

Copy of change of address confirmations

Copy of receipt from post office confirming that you did respond

Give them some time to respond, but don't let too much time pass as you don't want to assume at this point that they are now working on your case, or have reopened it, only to find out later that is not true. If I were you, I would make an appt. with Infopass to MAKE SURE they have your correct address on file.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

yes we save 3 copies for any paper and we sent copies for change of adress , post ofice , assest , anything they wanted and by the way my husband called the senator today after i typed here and thanks god they said they will help me as fast as they can , by the way we mad an infopass in memphis tn and they told me to send servics for re-open
