Hello,

My fiance is in Nepal. should i marry her and try for spouse visa or should i go for fiance visa. roughly how long does the processing of fiance visa take, in Nepal consular. Anyone who has idea please do help me out......

Differences in processing times are usually at the USCIS and/or NVC stage. The consulates are usually about the same for both spousal and fiance/e visas. Unless there is an urgent matter related to timing, you probably shouldn't use processing time as a basis for selecting whether to file for K1 or a CR1. Each has it's advantages and disadvantages. The K1 is usually a little faster, you will marry in the US (which may be important if you want family in the US to be involved), and derivative children can be older than 18 (but under 21). The K1 also costs more, and your new spouse won't be able to work or leave the US for several months (minimum) after arriving. The CR1 allows you to marry abroad (which may be important if you want family in Nepal to be involved), costs less than a K1, and your new spouse will get a green card soon after arrival, so they can work and travel. However, children must be under 18 at the time of the marriage in order to get derivative status.

You have to decide which aspects are the most important to you - which family members you want involved in your wedding, what costs you can afford, whether work and travel soon after arrival in the US will be required, and whether you'll be bringing over children with your fiance/e.

There is only one completed case from Nepal in the VJ database for a K1 in the past year. Based on that, it looks like the interview will be 1 to 1 1/2 months after the consulate gets the petition, depending on how quickly your fiance/e returns the forms from packet 3. The consulate reviews for Nepal look very good for both K1's and CR1's - quick interview and relatively easy approval.
