I recieved a letter from the NVC in the middle of October that they recieved an approved I-129F. I talked to someone at the NVC and they told me my petition was approved October 2.

I never recived a NOA 2 in the mail and the website for the USCIS shows my case is in initial review.

I called the USCIS and the woman on the phone was telling me that my NOA2 must be lost and that need to pay $300 to get another copy of it :angry:

I don't think they ever sent me one. How can I find out if it was sent and what do I do in this situation?

I never got mine either, I got it for the I-130 but not the I-129F. I called USCIS and they show it's still pending. I even spoke with a supervisor, which took 4 or 5 calls to get that person. She said that it should of been dropped since the I-130 was approved. She said I needed to call NVC center. I called them and and they said that USCIS approved it the same time the I-130 was approved. I got the letter from NVC that stated my case was in Hong Kong, even have a case number. I was told that the approval letter from them, is fine to use in place of the NOA2.

Just so you know there is a cost of around $300 for another copy of the NOA2. My issue was that it showed still pending, so I didn't want to pay the money to get nothing.

NOA2 for I-129 not received

Hong Kong Embassy received it on Sept 14th, 09

Packet 3 mailed out on Sept 22,09

I130 at NVC now

Received email Sep 23 about electronic processing for CR1

Packet 3 mailed on Sep 22, received on October 5th

Mailed packet 3 back 10-9 to Hong Kong, awaiting packet 4

Packet 4 mailed 10-15, Interview set for Nov 10th

In AP a little over a month

Got approval notice Dec 17th

Dropped passport off on 12-21

Received visa 12/24.

Flew to St Louis 12/29, now home.

Our NOA2 was also lost in the mail. We sent them one application, which was denied. Out of frustration, we went

and met an agent at the USCIS office. That person told us to re-submit all the evidence.

That person told us to submit all of our evidence that we were together and that she had entered the USA legally.

They told us to show my wife's entry I-94, passport, and other evidence.

Our cover letter explained all the details. We were then accepted. :dance: We are now waiting for our final interview,

and have a temporary work permit. So write a cover letter explaining what happened, and try again! The agent

did say that we might have to pay the 300$, but said it was worth it to try again.

If you have not already try to escalate your case on the phone with USCIS to an actual officer. The level 1 support is, well, not as useful. If all else fails contact your US Congressman and have them place a congressional inquiry. When all else fails, this can unstick many issues.

The EXACT same thing happened to me. We were approved in October, never recieved NOA2 & website still says under initial review to this day. I have called 4 times.

The first time I called they told me they would forward the case to the adjudicator who decided it and I should have an NOA2 in a few weeks (this was in November.) The 2nd time I called (in December) they told me I had to file the form for a duplicate copy & pay a fee, even though it was clear that there was nothing to duplicate since it hadn't been updated in their computers. I called back a few days later & spoke to someone else who told me I didn't have to file the form and that I should wait another month and "see what happens."

Today I called again and FINALLY spoke to someone who said that she had had a similar case with the same adjudicator and that she would take care of it. She took my phone number, said she would call NVC and get some info from them and have the adjudicator take care of it today. Fingers crossed that this time I ACTUALLY GET IT! My fiance has visa in hand and will be here next month so we NEED it for AOS!

Ok an update to my earlier post - I just now got home from work & had an email saying my approval notice has been mailed today. FINALLY! Only 3 months after it was actually approved. So...it is possible to get through this for anyone else who has been trying. Just keep calling!

Hello,

My approval for our j1 waiver was lost in the mail. We had a similar experience---our final approval was at vermont and we emailed the vermont center and they sent us out 2 letters or approval instead of one. However, when we called the USCIS they told us we had to pay $340 and file forms, etc, etc. When all else fails---I recommend e-mailing them, being polite and explaining your sitaution.
