wife was arrested for assault. It looks like it will be a misdemeanor. I know we will have to be honest on the i751. But will this ruin her chances for getting 10 year card ?

your timeline says your not in the US

so incase your not here yet , does your wife have a 2 year GC ( I doubt it since you just got married in 08 ),

cose to my understanding the i 751 is to remove condition on the 2 year GC

incase you go for DCF you would need a police certificate for filling DFC ,if the aussault is listed on the police cert ,

i belive it could effect your case if your wife is the immigrant

but hard to give advice without knowing your timeline

I have tried to upgrade timew line. but yes we are in the us she has her 2 gc and we have 6 months to apply for having the conditions removed.

When we were applying for the 10 year green card, we had to list his shoplifting charge on the form. It was pleaded down to trespassing or something like that. It did not effect the 10 year green card.

If I were you, and you were able, I would get a lawyer to plead that down to something minor. It is possible that an actual ASSAULT charge may not be favorable to the outcome you desire.

Well, misdemeanors are definately not as bad as felonies. And, I have not experience with the actual charge. But, I know they don't look favorably on people who want green cards assaulting citizens. Is there any way to plead it down further? You said "arrested".....does that mean no outcome thus far?

If not, I would say be as honest as you can be. Give them every bit of proof you have on the charge from arrest to the outcome, including any punishment that was handed out.

I am being told now that there is a chance that the DA could just drop the case. If it is drop or reduce do I need to say what the original charge was?
