I had applied I-130 for my wife in April-2006 and in OCT-2008 my DAUGHTER was born while i was a green card holder, now i m getting my citizen ship on NOV-12-2009.

Questions?

1- How to upgrade my wife's case or change category to expedite the process( I-130 Petition is approved week before i became citizen and transferred to NEWHAPSHIRE)

2- My daughter born 1 year before of my citizen ship, is she a us citizen? if not then how to file her case? or how to show her in my wife,s case so they can get immigration visa together.

3- After becoming citizen how can i file for my MOTHER immigration.

Thank you in advance for answering my question.

1. Write to USCIS and the NVC to update the petition for your wife. Let them know that you are a US citizen and request that your wife case be upgraded to an Immediate Relative. Include a copy of your citizenship certificate. Include case numbers.

2. Your daughter is not a US citizen. Use Form I-130 to apply for her. It will take about 6-12 months for her to get a visa. Once she enters the US as an immigrant, she automatically becomes a US citizen. File Form N-600 to get her a citizenship certificate.

3. Form I-130. One bit of caution. Make sure that you are 125% above the poverty level for 4 person (you, wife, child and mother) before you petition for your mother. It would be really horrible if you only made enough to petition for 2 people and either your wife or child is not included. I would wait to file for your mother until after your wife and child are in the US to play it safe if your are close to not meeting the poverty level. See Form I-864p.

My net income ( total income-expenses) should be above 125%? or my total income ( which is also called Gross income).

thanks again for replying. i will file next income tax above 125% of poverty line for 4 person.
