k1 visa can u apply if?

Timeline

My fiancee has lived in sweden since 2007 as an assylum seeker.He does not have perminate residency just assylum status.can they deny our k1 because he isnt a resident there or because he isnt swedish.

As long as he is legally residing in Sweden, there should be no problem with the US embassy in Stockholm processing his visa application. If he's an asylee from his home country, he may run into problems obtaining required documents from there, but that's a whole other can of worms.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

As long as he is legally residing in Sweden, there should be no problem with the US embassy in Stockholm processing his visa application. If he's an asylee from his home country, he may run into problems obtaining required documents from there, but that's a whole other can of worms.

Is he allowed to work as an aslyum seeker in Sweden? If so, he should be able to register with the tax office (even if he does not work), and thus get some sort of document to proof he is legally resident. As an asylum seeker, most European countries will issue some sort of identity document, or a stamp in the passport from his home country if he has one, he could show that?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
