I-134 or I-864?

Heads up all!

Not to cause alarm but I went to the NVC website http://travel.state.gov/visa/frvi/forms/forms_1342.html and at the bottom they declare “Important Note: The NVC cannot accept Form I-134 for immigrant visa processing. The NVC only accepts the appropriate I-864 form(s) listed above.”

I realize this is two separate entities, and two separate forms. I did not send my I-134 with the Petition to USCIS, and I have sent nothing at all to NVC; it goes from USCIS to NVC. K Visas require the I-134.

The Embassy/Consulate in Colombia site says they want the I-134 Affidavit of support.

I am sending the I-134 with the package to fiancée for her interview and as a precaution I am also including the I-864 for her to carry just in case they ask for it. Better safe than sorry!

Thoughts? Concerns? or just heads up take your pick!

The I-864 is only needed for CR/IR visas that are being processed at the NVC. All K visa petitioners will need to take form I-134 to the interview, not the I-864.

You will however need to send in form I-864 with your I-485 for AOS.

If im not mistaken they view k1 as non immigrant visa......but if ur applying for married visa or any other form of immigrant visa u have to use the I-864..........after coming to the usa on K1 visa when applying for aos u have to use the I-864 to my knowledge nvc never accepted the I-134 for aos or immigrant visa.

so basically from what i get from it is for the embassy for K-1 u still use the I-134 im sure if im wrong someone will come along and tell us.........

Correct. K1 is non-immigrant. I-864 is filed for AOS. The I-134 at K1 level is not a legally binding contract....more like demonstratable evidence that K1 petitioners will be able to support their fiancees once they are married and file I-864 at adjustment of status.

If you are a K1....it's the I-134 you need. Panic not, you have been asked for the correct form.

As stated above, K-1s are technically nonimmigrant visas, so the consulates review I-134 for evidence of support requirements. USCIS will require the I-864 at the time of the I-485 filing for AOS.

I-134 questions are addressed in the US Embassy and Consulate Forum, moving there...

Never know what COs may come up with. I think there is one embassy that wants the I-864 for a K1.

You butte is cover either way! Just be sure to have to supporting financial evidence.
