Ready to send Applications but really worried.

Make long story short:

-came to US 16 years old, B2 visa with Parents, Extension of B2 status approved.

-Went to school did change status to f1 approved 3 months after i stopped studying.

-Started college 4 months after full time (could not reinstate) everything now expired.

-Finished college 4 years working with a not valid ssn.

(Please don't judge, otherwise i could not finish college, parents got divorced living on my own)

always paid taxes with my TIN.

-Got married 3 years after graduating (Husband US Citizen). Now filing.

Should i be really worried?? Should i admit i'm working. I am almost freaking out. Have gotten mixed up advice from different attorneys.

Timeline

If you're only adjusting status from your expired visa to permanent residency, you should be fine. Like Len said, stop working now and don't ever bring it up.

Working without proper authorization is illegal. Working with a not valid SSN is illegal. Stop working. Now.

About 8 years, most of them I've been in college supported by my parents.

I know it is illegal (trust me i cant sleep sometimes) but loans bills and tuition are non stop and not paying them is probably just as bad.

No, it is not just as bad. I am sorry to tell you; but you will not find much sympathy in defending illegal work. Bills and financial stress happen to everyone, yet most folks do not break the law to make ends meet.

8 years out of status might be overcome by marriage to a USC; but the working part can bury you. I mean that.

No, it is not just as bad. I am sorry to tell you; but you will not find much sympathy in defending illegal work. Bills and financial stress happen to everyone, yet most folks do not break the law to make ends meet.

I do agree, and i failed to comply after so much sacrifice.

I guess i will just keep biting my nails and hope for the best.

OP is attempting to adjust status from an (expired) F1 student visa, not a family-based visa - moving to AOS from Work, Student, & Tourist Visas forum

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

The provision of the INA that allows the adjustment of status of out-of-status immediate relatives of US citizens also allows the adjustment of status of immediate relatives who have worked illegally. However, I do not know what the effect of the invalid SSN is. My limited understanding is that it may make a difference whether the SS# is fake, or someone else's.

You really need to find an immigration attorney experienced with this kind of case, because you need to know what to tell USCIS if they ask questions about work.

I've come on here quite a few times and, quite frankly, I'm disgusted at how judgemental people can be about illegal aliens in this country. This is especially the case given that this country wouldn't be what it is without the millions of illegal Mexicans who come across the border to try and make a better life for themselves - and who usually do the kinds of jobs most middle-class, white Americans wouldn't dream of doing.

Nobody wakes up one morning and decides, on a whim, that it would be a good idea to move to the US and be illegal. People do it because they're poor, and they do what they can to survive.

Lola2310 may be illegal, but she's managed to put herself through college, so she's clearly going to be an asset to the US once she's legal. Stop giving her a hard time. Unless you've been in her shoes, you're in no position to judge.

dirtyweebesom, get off that high horse. No one's posted anything judgmental in this thread. Several people have correctly stated that working illegally is a serious matter, all the more so when it's done through the fraudulent use of a SSN (which, if it actually belongs to someone else, can be prosecuted as identity theft). They were warning the OP of the very real possibility of serious consequences for her actions. The possibility of those consequences coming to pass increases with every day she continues to work illegally using false documentation.

No matter which way you look at it, Len's comment - "Bills and financial stress happen to everyone, yet most folks do not break the law to make ends meet" - is judgemental. However, I wasn't only referring to this post. There are numerous posts on here where people condemn others who've worked illegally. All I'm saying is don't judge until you've walked in the shoes of the person you're judging.

Lola2310 may be illegal, but she's managed to put herself through college, so she's clearly going to be an asset to the US once she's legal.

If she doesn't stop working under false pretenses, she may never become legal. This is dangerous ground and some people seem to take it way too lightly.

Wowowow, i am not killing raping stealing or anything of that sort. My life is run by a TIN given to me and everything i do that requires a number (except for work) is been done with that.

I am not stealing any identity, i have my own credit cards loans bank accounts phone bills everything, thanks to my F1 status and my Tax Id which was requested by my parents from Day one.

I pay taxes for every penny i had earned from my hard work and i am not collecting help from any government agency nor am i planning on doing so!.

I understand that there are many people that do this and go over board and steal people's identity and pretty much ruin their life. I am not one of those.

The only one time i used that number was to get my job after having an internship there while in school, nothing else.

I understand all of the concerns here, and i do not recommend anyone doing this, it has been very difficult for me.

Probably even more difficult than being in a country that i consider as my own yet i don't belong to due to a paper.

I don't think i can even feel comfortable on my native country after so long, i can barely speak my "native language" anymore.

So i DO NOT say this is good in any case. But it does feel damn awful being compared to people who are just plain crazy and sick of their minds.

Well. I'll keep posting and praying i don't have to leave, my husband just landed a big gig and i can not even think i would be able to leave him.
