IMBRA RFE after filing new I-129F

Well as you all may know, I'm the guinea pig for the adjudication of IMBRA petitions with convictions relating to Alcohol. I sent in the new I-129F petition with certified court records, minus the police records. I got in the mail what looks to be the standard IMBRA RFE today.

I sent in the original certified copies of the court records with my petition and didn't make copies of them (I know, dumb move). I am now going to complete the requested information of IMBRA by sending in the police records with the RFE.

Do you feel that VSC will have all the original court records still with my petition? Do you think I should send a letter stating what I've already sent in? Should I call the VSC (whoever it is that takes calls) and tell them what I've sent in already to make sure they have it? I'm worried that they will somehow misplace or look over the original sent documents. What should I do in this case? :help:

I wonder if a second RFE is a standard now for new petitions. I will post my opinion of why the new I-129F petition might receive a standard RFE in another thread.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

Okay, I'm only guessing here, okay? And I'll just say what I'd do if I were you.

Since you don't have copies of what you've sent them with the I129f, I guess you're right when you said you should send them a letter with the RFE stating what documents you've already sent them with any information you can get, some kind of info that allows them to identify your documents. To make you feel better, I feel that VSC still have the original court records you sent out - but, you know, s**t happens sometimes (just see what happened to some of the recalled petitions - they just can't find them anywhere).

And what if they don't have the court records? Hmm, I'm not really sure, but my guess you'd get yet another RFE.

Just be sure, from now on, to keep copies of whatever you send them - they even say it in the USCIS site, if I'm not mistaken.

The reason for the IMBRA RFE was soley for the purpose of bringing petitions filed with the old I-129F into compliance. Without such the petitions could not be processed/approved. The same went for those that were recalled after approval. IMO they just got over zealous and erroneously issued you an IMBRA RFE as if you had filed the old form. I would even go as far as to return the RFE with an letter stating that you filed the new I-129F which already answered those same questions and that you submitted court records blah blah blah. You could then also take this opportunity to submit the police records that you failed to do with the initial submission as you will get a further RFE for that eventually.

Thanks guy's!! I feel better about the situation and a little less lost. I hate not being in control of what's going on. I hate not having a more hands on experience with USCIS. I'm used to calling a getting answers from people and businesses I work with. I will follow your advice and then only time will tell. thanks

Well, like any good petitioner, I contacted the VSC concerning The RFE. I told them that I had already sent in the original copies of the court records and had already answered the IMBRA questions in the petition I submitted. The lady responded that I should answer the petition to the best of my ability and send in copies of the paperwork I had already sent. I asked her "don't you keep the originals with the petition when it's first received?" she replied "yes we try the best we can, but for some reason and I don't know why, some documents get misplaced around her" I gotta tell you folks, that was comforting!!

So what does a guy in this position do now. Well, I'll tell you. He's going back to all the court houses to get the necessary certified documents and is going to send it all in together with the police records!! I don't want to have this burden of worry on my shoulders that the originals may have been lost.

You can't change the mistakes you've made in the past. All you can do is move forward, learn, and make corrections to avoid making the same mistake twice.

I'm so tempted to just send back the RFE with a letter stating I already sent in the documents. This seems like a common mistake by USCIS sending the RFE. I guess it's better to wait and send everything plus more again with the RFE. I can't stand being at a stale mate!! I want to move forward. It will only take me another 5 days or so to get the paperwork again. I guess I can wait!! another RFE for the same thing could be a 2 week delay or more. :whistle:

I would be very tempted too. But it's better to be safe than sorry, considering you don't have copies of some of the stuff you've already sent them.
