Confused about next steps

Ok - so I got my fiance here - life is good. We will marry this month - but what happens next ?

I know we will do the AOS - but may take a few months now to save up the fee of 1010.00 - since I took a part time job making a lot less then originally when we filed our I-129F due to the down turn in manufacturing this year for the embassy part.

So as long as we marry - he is allowed to stay ??

Is there anything else we need to do ? His 90 days up is in January 2010 - we hope to file AOS before this time but just in case ??

congrats on your process , what you can do now is go to the social security office ( best to go about 10 days -2 weeks after his arrival so they have his statues in theyr system )

apply for a SS# ( I did it after we where married and had a hell of a time getting one )

but you say "he is here " so I figuer your fiance is male and wont have a name change after marriage ,

cose had i knowen what a pain it would be to apply after marriage I would have applied before too ,

other then that nope nothing else to do then get married then file for AOS when your ready

( the 90 doesnt effect the AOS you can file anytime after marriage , 90 was the timeframe you have to get married )

the only effect the expiration date on his I 94 has, he will be out of status till AOS is filled , but yes he will be able to stay here with you even if AOS is filled after 90 days ,

we checked the check mark on the form for the social security - i read somewhere if not received like in 4 weeks to go check at the local office - so we will wait and see then do this.

the check mark does not aply to K1 visa , its only for spousal visas

I wasn't even sure what you mean by 'check mark'. Are you talking about on one of the forms your husband filled out at the consulate?

If so, that is only for immigrant visa applicants. K visa holders must apply for an SSN at their local SSA office once they arrive stateside.

hi tracy I think she ment the check mark option on ds 230 , and yup like you said that only aplies to spousal visas

Immigrant visas - it doesn't work with K3s (also a spousal visa) either.

I see that you're in Texas. If you are not able to file for AOS before his I-94 expires be sure that you don't travel anywhere near the inland inspection areas on the highways closer to the US/Mexico border. He could be detained if out of status and AOS not applied for.

Not trying to scare you, but this has come up here on VJ.
