No Visa for Christeen

Well, pretty sad today! Husband went to the interview and the CO was pretty harsh... All of our marriage and relationship documentation was OK... But they did not accept our financials...

We filed using my husband and mine investments in Italy as well as his work (we had a letter from his current employer staying he has been working for them since June and this employment will continue when he comes in the USA... He would be making $5,400 a month... They did not accept this).... I am slef employed and my income does not count enough for sponsoring alone.... But they are not counting his even though he is working for the company but no taxes are being taken out (DUH... he's not in the US to pay taxes on it yet)...

Next, we have a substantial investments in Italy and had our bank proof.... She said she would only consider $$ in the United states...

Next, he shown her our accounts in the US which are in both our names... She would not count those assets because they were in both our names and I needed it in my name to sponsor... She did not want to look at the other assets... So basically between us we have over $300k saved and she would not look at any of it...

She sent my husband away with the 221g stating that we had to show proof that I had over 55k in MY name in a US bank... So I just got done doing all my transfers around to consolidate that amount into one account under my name... I printed/scanned the info and e-mailed that to them.

Teh good think is that They kept my husbands passport and the CO said that if they received the e-mail with proof of funds in my name and it was satisfactory.... then the visa would be in the passport when he picks it up at 6PM... If he picks up the passport and there is no visa in it, then we have to see what we have to do to comply with the 221g. We dont know what to do then!!!

I am feeling really down now and just want to lay in bed till its time for my hubby to pick up the passport and I pray that there is the Visa in it!!!!!!

I sent them everything now

but if nvc was ok with your financials why would the CO have a problem?

i'm assuming this is aos info they have a problem with him

I864 delivered November 2nd.....nvc logged it on November 5th

Well, this morning I moved all the money around and produced the bank account statement showing the required amount under my name. I sent the e-mail so I guess that we will not know if it was approved until he picks up the passport at 6PM... It will either have the visa, or no visa... Then we will have to see what needs to be done... The CO definetly did not follow the instructions on the 864.

We used my husbands income and had a letter stating his income and that this income would continue after arriving in the USA along with a contract for work. Plus his/my accounts in Italy (she would not consider any money not in a US bank and under just MY name!)) Everything was OK'd at NVC, but she would not let it by...

I am pretty distraught right now with worry...And pissed as I did everything right....

Don't worry too much. I'm sure your husbands passport will have the visa when he picks it up later. Think positive!

Okay, I firmly believe there is going to be a visa in that passport, and you KNOW I'm not ordinarly a positive person, so that's saying something!!!!

I know you're beside yourself with sadness and worry, and you will be until you get that call.

You've done all you can at this point, and I can't imagine they'd deny you.

Hang in there and stay with us. We'll get you through the day. :thumbs:

Im sorry Christeen, I hate this whole process, they play God and decide our lifes, its not right. I still have not heard from embassy, I emailed them 3 times, called Dept of State again today, and just emailed our states senator.

Next email is the American Ambassador in France, enough is enough.

Oh my gosh you guys! I am so sorry to hear all this stuff -- it's heartbreaking for sure. But I really think that you both are going to be jsut fine as well... they too both your husband's passports and they can't do that unless they are planning on slapping a visa in there... you'll see.

Paris, I have a question for you -- if your husband's residency runs out in France and they give him his visa on the 6th, is he going to be okay? Can he just take a flight to the US at this point? Does he have to leave France right away is what i'm asking....

I hope it all wo rks out for both of you -- my gut says it will.

Christeen-I have a great gut instinct. One they get all the proof, your hubby will get his visa. I know it's hard but hang in there-things will turn out well!

Our timeline:

2/88: We met in Sydney, Australia at a youth hostel! He's Finnish, I'm American-both were in our early 20s at the time and fresh out of college (so couldn't afford to visit each other's countries after that!). We had a three-day romance, then went our separate ways. He actually was going to Sydney a week later, but decided at the last minute to cut his trip short in another country and go early. Wow.

1988-1998: Wrote "snail mail" letters/sent Xmas cards, but lived our separate lives. I married someone else, divorced in 2006...he lived with someone for years and then that ended.

10/08: Because of a series of random life events, I Googled my Finn Man and found him (but no link to his email, and the website his name was on was in Estonian so I couldn't even read it!). It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!
