Hi VJs,

I have finally received my interview appointment, Dec 15 2009 after much complication to provide police certificates. I have two questions as our 2nd wedding anniversary falls on 30 jan 2010.

1. Is it possible to reschedule my interview since my husband is coming at the end of December? Further, I need to apply for Queensland Police certificate and it will take approximately 7 weeks to process (this will be the fourth time applying for an Australian Police Cert, not sure why NVC are so particular just because I studied there?)

2. I have read some forums regarding IR1 decided at POE. Does this regulation still apply? I would think that we will be granted CR1 in December and would like to fly to Chicago after the second anniversary to receive IR1. I need some clarification and any previous experience is welcomed. Just afraid that the officer at the POE will still grant CR1 after two years marriage.

I have also read at entry they should be able to grant IR1 even if the visa is listed as CR1, if 2 years has passed since marriage. But I also would like confirmation! :) :)

Whether you're issued an IR-1 or CR-1 depends only on the age of your marriage on the date you enter the U.S. If it is more than 2 years, you should get an IR-1. That being said, however, there have been some who have erroneously been issued a CR-1 who have been married longer than 2 years. I've heard it said that you must bring it to the attention of the Immigration officer at the POE that you have been married longer than 2 years in order to be sure you get the IR-1.

No matter the GC is issued in December, it doesn't get activated until POE. So, if beneficiary is close to 2-year old marriage, then wait till the 2nd anniversary passes to enter USA to get IR-1. Interview date does not affect it. It's the POE that does :thumbs:

You can still reschedule interview for later if you need to. The embassy shouldn't mind, just explain you need time for that Australian PPC :thumbs:

Hi, I'm actually having this problem at the moment.

My visa was issued at the end of July in London, our 2nd Wedding Anniversary was beginning of August and P.O.E was in September. I was issued CR1 in my passport and the immigration officer at Chicago airport said that wasn't his problem and to contact USCIS. At that point in time I'd just had enough and wanted to get through and sleep. I called USCIS service centre and they said to make a appt at my local field office. So I made an appt at Milwaukee field office and they told me I had it all wrong and that I was issued CR1 in London and that was that, no changing it. After much arguing, with a very insistent lady, I left doubting myself and what I'd read here, on the DOS site and various other places. I went home and reread just about everything I could find regarding the whole CR1/IR1 differences. When my green-card arrived it was CR1 still, obviously, so I've (reluctantly) sent it back to them with a cover letter explaining about the dates, our wedding certificate and the I-90 form, no fees needed.

I sent it back on the 20th October, they received it the 23rd Oct and sent me a receipt. In the meantime I have the CR1 visa in my passport which is valid for a year, I believe, to show eligibility for work etc. We were really looking forward to being done with all the USCIS and immigration stuff for several years but I guess it wasn't to be just yet.

Abandoned application and OH moved to the UK.

April 2009 starting all over again DCF this time.

Marriage : 2007-08-03

I-130 Sent : 2009-05-02

I-130 NOA1 : 2009-05-06 (no receipt received this is the date the money was taken from credit card)

RFE: 2009-06-02. Credit card receipts and dreaded RFE's.

RFE replied to: 2009-06-04. Hoping they have everything they need

NOA2 approved: 2009-06-11.

NOA2 received: 2009-06-15.

Packet 3 received: 2009-06-17.

Packet 3 returned: 2009-06-17.

Medical booked for July 13th.

Medical done, passed pending xray and blood tests.

July 13th: Still waiting for interview date...phoned DOS and they said everything is in order and we're eligible for an interview and to be patient...back to waiting.

Called DOS again 17th July, they said we have an interview date whoop!!

Interview: July 29th (hubby's birthday) WOOHOO!! Visa approved

SMS message 31st July saying visa will be delivered on Monday.

August 1st: Visa here!!!! whoop whoop!

So much left to do...but the worst is over :)

September 14th: POE Chicago

The thought of doing all that kindda knocks me off. Seems like living with a lot of judgement.. I hope all goes well for you. Hope to hear good news.. And my POE will be in Chicago too, so that kindda make me sad.

It's not automatic, one must actually engage the CBP officer in a conversation about IR-1 designation, 10 year card issuance, at the POE.

Seriously.

Expect nothing automatic; instead - expect that you MUST have a conversation with a CBP officer at POE.

thank , I'm so confused about it , i heard that if i mention the IR1 to the officer he will think that I'm using my husband :wacko: and if i dont mention it i will lose the 10 years

what to do ? my second wedding anniversary will be on april 16 and i'm planning to enter to the U.S on april 18 :help: please

Moretti - Can I ask you to update this thread? Did you ever get them to give you the IR-1 without waiting 2 years. My wife is thinking of doing something similar to what you did but we definitely don't want the hassle of getting a CR-1....

Hi mcelliott,

They did replace my CR1 for the IR1, no charge and took about 1 month to receive the card. So I got the full 10 years and it was well worth to be done with them for 10 years. If you need any extra info, let me know. Good luck. :)
