I started checking Oct23 it's the Friday before Oct26 which didn't have any changes today.I've found 3 for 2-5-2010 so far and i'm still checking. I wanted to see if I could find about how many cases the VSC were averageing a day. Because my current assumption of them processing maybe one day full of cases a month is to depressing.

I don't want to think about them processing Dec. I want to try to start working back. So can get an Idea of how many cases they process in a day. Because from the data in the group of spread sheets. It seems the VSC accepts around 100-120 I-129f cases a day. If they are working on cases submitted around 100 days ago (excluding the lucky aholes in dec. ), its important to know about how many they can process in a day. Lets say they can process a 100 cases a day. (doubtful). Then lets look at where they seem to have peaked at, OCT26 which is about 80% complete. Now starting with Oct27 which I rechecked today and no changes were made and there is still about a 100 cases to process. If the VSC can process 100 cases a day and each day averages about a 100 cases. It will be another 18 days before they reach my day Nov13. However if they are processing 10, 20, 50 cases a day. I feel very sad.

( :( I forgot they don't work weekends, that makes it even longer)

During AUG, SEPT, and OCT last year they averaged approving about 240 cases a day. They completed 4892 cases in AUG, 5202 cases in SEPT, and 4657 cases in OCT. In NOV their approvals dropped down to 2155 cases. Which is about 105 cases a day. On Feb 15 they will post their DEC statistics. Over the entire year last year they averaged approving between 100-120 cases a day.

This is starting to drive me completely insane. Why December 15th......why why why just a random freaking day. Almost 50% petitions looked at #######.

I have a feeling that they just sit there, put down all the days on a piece of paper, shuffle them in a hat and then pull them out. Someone lost a bet and has to do the whole Dec 15th day this month I guess....

I am very surprised you are drawn into this November post.. If I remember correctly you were happy when I chilled out with my stressful posts..Look at Dec. 09 posts nobody has posted for a week now.. We are not counting dates and the like. as these November folks...... As you stated in another post .. time is the key to the process...... Right now we are dealing with 24" of snow and the last thing I want to worry about besides how do I get to work in this bilzzard is who's on first.! If you need a chill pill I'll send you one. All pun intended but as you stated weeks ago we all will have our time my friend,..... I am days before you and I have to deal with the same thing you are...When they finish with this Haiti priorty we will get ours..

Wow 240 a day, I wish they could get back to that. Heck 105 is still hopeful. Might see a noa2 before first day of spring.

10.11 Order of Processing.

(a) Routine and Expedited Cases .

Generally, applications and petitions should be processed in the order in which they are received. Exceptions can, and should, be made for a number of different reasons, and sometimes those reasons may appear to conflict with one another. Reasons for prioritizing certain applications and petitions over others may relate to:

· A statutory requirement, such as the requirement that joint petitions for removal of conditions under the marriage fraud amendments be interviewed within 90 days of filing and adjudicated within 90 days of being interviewed ( section 216 of the Act), or that L-1 petitions be adjudicated within 30 days of filing (section 214(a)(2)© of the Act);

· USCIS -wide policy pertaining to the type of application or petition being filed, such as The USCIS Director's fiscal year priority that backlogs in a given type of application or petition be reduced to a specified level;

· Current events in the homeland of the applicant or beneficiary, such as a natural disaster or civil war;

· Imminent events which may effect the eligibility of the applicant or petitioner, such as the termination of a program whose duration is limited by statute or the "ageing out" of a dependent,

· A need to coordinate actions with other branches of DHS, or with other agencies in order to meet common goals

· To correct an injustice which may have occurred, or to prevent one which may be about to occur.

(b) Cases Held for Submission of Additional Information . [Chapter 10.11(b) update effective June 18, 2007.]

When an application or petition provides insufficient information to make a decision, USCIS may request additional evidence. The request for evidence or notice of intent to deny must be in writing and must specify the type of evidence required. The request must state whether initial evidence or additional evidence is required. Alternatively, the basis for the proposed denial must give the applicant or petitioner adequate notice and sufficient information to respond. The request for evidence or notice of intent to deny must indicate the deadline for response. See 8 CFR 103.2(b)(8) .

USCIS may hold the case in abeyance while waiting for the applicant or petitioner to respond. However, the maximum response time for a request for evidence cannot exceed 12 weeks, and for a notice of intent to deny cannot exceed 30 days. Additional time to respond to a request for evidence or notice of intent to deny may not be granted. See 8 CFR 103.2(b)(8) .

If USCIS receives a response, or the time to submit a response elapses, the case shall be returned to its original processing place. Returning the file to the original processing place will normally make the case ready for immediate adjudication.

Note See Chapter 10.5 for a detailed explanation of requests for evidence and responses to a notice to deny.

© Cases Pending Investigation or Decision Deferred for Other Reasons .

When a case is returned from Investigations, it should be returned to its place chronologically, according to receipt date, for processing. Cases sent to Investigations should remain on a local call- up system within Adjudications and reviewed periodically to determine if investigation is still warranted or if circumstances have changed. Similarly, if a decision on a case is deferred for any other reason, a call-up system should be maintained locally and the case reviewed to determine if circumstances hav e changed sufficiently to warrant final action.

My fiance called his congressman on Thursday. no good news :(

He told him that he'll look into our issue (december files being processed before oct-nov), and try to contact someone from VSC, but that he doesn't have any control over there.

Drue told him that other ppl are calling their congressman too.

He said that honestly, these congressman will tell them they will do everything, and then won't do anything at all (I really hope he's wrong). and that he didn't wanna play that game.

He told him the best thing to do is call a lawyer. Drue called one, and they said that it may take over a year to gather enough information and take them to the court.

Then Drue called VSC, after 30 automated menus, he could talk to someone, who said the same BS over and over again. So he asked to talk to a supervisor, she said none were available. He asked for another number he could call to have someone who know more things that she does, she said she doesn't know any. He said it's weird that you work for them, and u donno any of their numbers. so she repeated her BS that they will notify us by email, and hung up.

So if u guys call ur congressman, ask them what exactly they are going to do, and when, cos it's easy to say "we will look into it", and then they will go "oh, we couldn't do anything".

I'm very mad now, and really donno what to think.

So I hope to see some movement next week, otherwise, I'll kill someone

Hi. I just sent our I-129F off today and thought I'd kick it off for the November crowd. My fiance left the US and I'm already going crazy waiting for him to be back here, but it sounds like I've got to get used to the idea of being a bit lonely for several months yet.

Any other November filers to commiserate or be hopeful with?

My fiance is in the States and we have filed through my lawyer in Canada filed, at the end of Nov/09. They had received his petition but I haven't heard anything back yet, just sitting on pins and needles and very lonely to say the least. Not sure what to expect next or how long this entire process is going to take.

Additional time to respond to a request for evidence or notice of intent to deny may not be granted. See 8 CFR 103.2(b)(8) .

If USCIS receives a response, or the time to submit a response elapses, the case shall be returned to its original processing place. Returning the file to the original processing place will normally make the case ready for immediate adjudication.

When a case is returned from Investigations, it should be returned to its place chronologically, according to receipt date, for processing. Cases sent to Investigations should remain on a local call- up system within Adjudications and reviewed periodically to determine if investigation is still warranted or if circumstances have changed. Similarly, if a decision on a case is deferred for any other reason, a call-up system should be maintained locally and the case reviewed to determine if circumstances hav e changed sufficiently to warrant final action.
