Russell applied for his SSN on December 27. The letter said it would take about four weeks as the had to verify documents. At five weeks (with no card yet) I called the national number and then the local number for SS, who basically both told me to piss off and wait for his card. I waited a couple more weeks and still no card, so we stopped by the SS office today.

When they called our number I told her what was up and then she told us to sit down and wait again for another person to call us back into the offices. He came and got us, and told Russell his application for a SS number had been denied because he was a K-2 visa holder and K-2 visa holders can't get a SS number.

Umm hell-f'ing-o -- Russell is a K-1 visa holder.

Does he look like someone's under-21 unmarried child? Does it say anywhere that he came into the country as the dependent of a K-1 visa holder?

Apparently when the SS office sent his information down to Phoenix for verification, they didn't even make note of what type of visa he was on in the system. They just sent a photocopy of his I-94. The I-94 says it expires 3/6/06 and has 'K1' written in someone's horrible penmanship on the front. They made a loop on the bottom of the 1 so with a cursory glance it can look like a 2.

So we have two potential causes of this problem:

1. DHS is dumb and entered the wrong K visa into the computer despite the K-1 on the front of the I-94, or

2. DHS is dumb and didn't even look in the computer to verify Russell's documents, they just looked at the I-94 and thought it said K-2 and copied down the expiration date that was on it.

Either way, ... well... you know.

It is plainly obvious that there is no way Russell is a K-2 visa holder. Our AOS is being processed for our K-1. I doubt it would have gone through if they had K-2 in the computer and we wrote K-1 on the application. It even says 'K-1' on the ACTUAL VISA in his passport. You'd think the visa would be an important part of documentation verification, but no, when we first applied for a SSN he didn't make a photocopy of it because he's apparently inept. I showed it to him today and I even logged on to USCIS online and showed him that our I-129F was approved for the K-1 fiance visa. But because some idiot in DHS dropped the ball and gave him conflicting information, his hands are tied and he has to resubmit our application for another verification, which will take "four weeks."

I'm so tired of seeing these stupid mistakes that get made in the whole immigration process. "Oh, sorry, we sent your case to Australia instead of Poland eheh oops. Oh sorry, I forgot my glasses today and reversed your first and last name, spelled your middle name wrong, and checked male instead of female on your green card." Let's not even get in the waiting times... if you have that much of a demand for application processing then HIRE MORE [your choice of expletive here] PEOPLE.

Sigh.

Oh, and they got the verification saying that Russell's on a K-2 back on January 10. We saw it stamped on the form. The SS man said that the SS office JUST sent out our denial letter today. "Happy Valentine's Day, you're denied!" :lol:

You wont get it straightened out until you have the EAD. We went through similar insanity and there is nothing you can do.

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

This EAD comment assumes you are pushing the 90 day after entry mark. When you get within about 2 weeks of that date the SS folks will do nothing until you get a green card or an EAD. Your timeline does not have enough information to know that date. I read the post too quickly and assumed you had been here for quite some time.

In or case we filed for SS 2 weeks after Lucero entered and messed with them for 2 months until they shut down on us.
