Timeline

Ok well, I hope our story will help others, for those who see us in the forums, you read me ranting about Nigel's incident of letting air out of some guys tires as a youth. He thinks he was about 18 but we sent away for his ACPO like we're supposed to, and it came up as 'No live trace" so that means that there is something on there but it has been "stepped down" or old. Nigel didnt think nothing of it and of course, me being a worry wart told him to go order this Police Subject Access to see if its on there because it doesnt seem to be in the court where he is anymore. It takes up to 40 days to process, well we didnt think our interview in London would be so fast, so we are still waiting for it and so we just went today for the interview without it and here's how it went:

The adjudicator asked about the incident and Nigel told them it was when he was about 18 years old yada yada....the guy had a big lady behind him coaching him along(the boss?)....(go figure) soooooo, they approved us pending the documentation. So Nigel's got a envelope and a number for the courier to send his docs and passport back to them and then they send the visa to us.

Sooooooooooo....needless to say I was a basket case today, all upset, but I know its not a denial so thats good.

Plus I looked at the immigration and naturalization act section 212 and they cant deny anyone who was 18 or over, spent less than 1 year in jail, was more than 5 years ago from filing the petition. Thats the abbreviated version. So we knew our rights on this one, we just have to show proof of the offense or whatever.

That's very good information to pass on for others who may have some minor teen age offenses. I'm sure it will be totally fine, but the anticipation of a visa gets shattered by some more waiting, so it's understandable to be upset. Our emotions get so caught up in the long process. Hang in there and know it's going to turn out okay in the end if you can just endure the wait. (F)

Well, pooh.

You know - I bet my husband would have had to get a Subject Access report. His police report (the old version) in 2005 was clean. But I bet he would have had a "no live trace" on this new version.

The story he tells me is that in his teens, he and some of his friends were 'running about'. A boy in the group jumped up on the hood of a car and (naturally) did some damage. Later on here comes the police around to everybody's houses trying to figure out who did it. All the boys were 'threatened' with arrest if they didn't tell the truth. My husband had to give a statement. I'd lay you odds that would show up on an ACPO report.

Im glad it wasn't denied, just means a litle bit more of a wait for you. The waiting is the hardest and I know you have had more than your share. Its funny how stupid things we do as young adults can come back to bite us. It seems all a bit silly for a small childhood prank. Let us know when you get everything sent in and visa in hand!

Isn't Subject Access the old type of info we used to have to apply for before this new more expensive ACPO came around? sure sounds like it....10 pounds and a 40 day wait, I'd be surprised to to see anything different on it than the ACPO you already have, what on earth are we paying all this extra money for if it isn't even giving out decent info?...interesting, keep us updated and good luck!

Yes, I was thinking the same thing, why did we get this ACPO thing when its completely useless on old spent convictions/records! It showed absolutely nothing but "no live trace" like that's really gonna help us! Idiots. Sooo, I am gonna post like crazy if the old Subject Access shows stuff by the end of the month if they get off their arses and process it in time...which is the 20th of this month will be about 40 days for us. Plus, get this, I e-mailed Nigel's MP in his district today to help us find where his town court house put the records since they bulldozed the building down a few years back. Derbyshire magistrate court has nothing, well, they say they have nothing over the phone, just his dad's old speeding ticket! Sooooooooooo stupid, this dance is!!!

To be honest, I'm very surprised.

I also had NO LIVE TRACE on my certificate but have no memory of ever being in trouble with the police. When they asked me, I told them that. I was approved and no one mentioned anything. Maybe he brought attention to it by bringing it up? I dunno, it sounds strange as I've seen others get approved with that type of result too.

Anyways, this waiting will be over soon. As someone else said, he'll be home for Christmas. :)

Well he has put on his form in the packet 3 stating that he HAD been arrested before for a offense. He mentioned a bit of it, the stupid honest man, told them he was 18 or so blah blah blah, stupid letting air out of tires incident, then in the interview he told them honestly, and the guy had a big lady looking over his shoulder and so they wanted what they wanted I guess. We went in there with blind faith pretty much thinking that the REQUIRED ACPO was what they wanted. Stupid. So tomorrow i'm following up with the local MP and have them find out where the court put their records since that building is since bulldozed down. I know our laws for this offense and they couldnt deny him if they tried! We just have to prove the offense and when it was....you'd think they'd know what NO LIVE TRACE meant, if its old stuff they'd leave it alone. JEEZZZZ

Get this, I was informed by Nigel today(woohoo the guy did some work!) lol.. that being his records are more than 15 years old the Derbyshire court moved the records to Chesterfield...jeezzzzzzzz, so we know where that is, its not far, strange that they moved them to another county Staffordshire...(forgive the spelling)so we're gonna have him go get them and see whats what. In the meantime, we're waiting for that subject access.

I requested for the imformation on a caution i received in 2004 , i got a NISAD back with all the information . Also Iv jus started a new job and they do a CRB check and my caution comes up on that. I rang up the CRB and they said that this caution is on record for life and that anyone that request it thay have to give it.

should i send a copy of this information with my DS forms??

Yes, give EVERYTHING. You have to have the standard stuff, the ACPO and related court things if you have anything on your record, I mean ANYTHING. The folks at the interview LOVE PAPER...more the merrier. London doesnt care about relationship doc's however, thats alright. I've never heard of those forms you speak of....whatever, clearance info is clearance info...

You MUST need this---regardless if you have anything on you.

"A visa applicant who has resided in the United Kingdom for 6 months or more since the age of 16, is required to obtain a police certificate from the Association of Chief Police Officers (ACPO). Further information is available from their website at http://www.acpo.police.uk/certificates.asp . This police certificate will serve to advise the U.S. Embassy, London whether or not any criminal conviction is held against him/her.

The police certificate will be sent to the applicant's address provided at the time of application. Please note that the Immigrant Visa Unit considers the police certificate valid for 12 months from the date of issuance, not six months as stated on the certificate."
