A lot of work visas don't issue EADs. I know the F1 OPT does, but i don't know of any others. Mine was a H work visa - (H2B category) they issued me a visa and I-94 - the visa said which company I could work for legally. Mine had to be renewed every 6-9 months. When I renewed it they sent me a new I-94 with whatever company's name on that I was legally allowed to work for. The new I-94 established my work eligibility. If mine was still valid I could still be working for whatever company it was sponsored by.

You can still apply for an EAD though even if your work visa is still good - as an EAD would give you the freedom to switch employers etc... Especially in the unlikely event of your work visa sponsor laying you off.

As far as I know unless Social Security screws up the social security card is restricted and doesn't show you're eligible to work until you become a permanent resident. Even when we have our EAD's the social security card will still say `only valid for work with DHS permission.' Which kindof sucks as if my SS wasn't restricted I could totally work right now as my Driver license is good until 2012!

Happy New Year in advance to everybody!

I just received my AP documents in the mail. I don't have any plans to leave the country any time soon (I'd prefer just to wait until I get the greencard) because I'm worried I'd be deported if I left and tried to get back in. Can anyone give me any advice?

My F1 visa expired May 31 2009, and my OPT EAD expired in the middle of July 2009. According to my AP document, I'd only be deported if I'd overstayed my visa by 180 days, but when does the countdown begin? Is it from the date my visa expires, or the OPT? Either way, I think I'd be OK, but I'm still nervous about leaving.

Like I said, I probably won't leave, but a Mexican friend of mine said she'd like to drive with me back to Monterrey, and it would be nice to know if this would be possible in the near future.

What do you think?

Congrats!! Well I dunno... I wouldn't risk using the AP myself anymore since now atleast we can do sort of planning since our interview is scheduled end of Jan and we really only wanted to go anywhere in Feb so we'll just wait for the GC... from reading on here, it seems like they'll take your money for the AP, but whether it actually guarantees you entry is another story...

It's good that you are all getting interview letters, as that gives me a good idea of when my own interview will be. I'm guessing late January/early February, too.

Congrats to Dirtyweebesom on the AP :thumbs: I'm too scared to travel on the AP too even though I haven't been out of status. But yeah it scared me!

Unless my AOS takes over 6 months I dont plan on using the AP unless I have a family emergency. I'm sure i'd be ok though - just don't want the hassle/worry. Like Dirtyweebesom I wondered if I could go to Mexico with the AP. When I was in Tucson a few days ago my MIL wanted to take me and my brother in law's gf shopping in Mexico. We didn't go as I didn't have the AP...

IO's scare me as last time I arrived into the country they opened a new gate, I was the first one to go up to that gate, and the guy was hammering his computer keyboard and scanning my passport repeatedly. I think he just had computer problems but he didn't tell me anything just picked up my documents and sent me to the second interview room. The guy in the second room was super nice to me, didn't seem to understand why i'd been sent there and just asked me where i was going to work etc... wished me a good day etc - then I noticed the first guy had stamped approved - anyways. But yeah it scared me!

Yes, IO's are always soooooo mean even when there's no need to be. Well, my husband is still in Cleveland (coming back Saturday night) and I am just going to stay at home by myself like the crazy cat lady that I am! I swear to God that getting my fifth cat in September tipped me over the edge. I was fine when I had four, but after five, I started spending hours posting pictures of my cats to Facebook and asking my friends to "befriend" them on Facebook! :unsure:

The worrying thing is that I don't mind at all. I am so happy just hanging out with the cats tonight. I think I need an intervention!

lol! Awww that's so nice though! Don't worry if it makes you feel better, a few years ago one of my friends on the east coast asked all her friends to befriend a stuffed animal on facebook - seriously!!! She'd taken pictures of everyone at work with it and thought it would be cool to give it a fb page. Then tagged everyone in the pics! At least your cats are real!

Notice was send on December 28th (Which happends to be my father's birthday. :lol:)

Now I'll be nervous, trying to get everything together... But I must admit I have a good lawyer so it will help. I'm such an anxious person... I could probably have done it on my own, but getting a lawyer saved me 4-5 months of constant heartburns.
