Wait...what is your timeline of events? What is the exact wording of the letter you received?

Did you receive a receipt of for your petition the first time you sent it off? This does not sound like a DENIAL, just that your application is 'incomplete' and they want you to complete and re-send. If you say denial, it makes us think that your petition has been adjudicated and denied based on the missing signature, which would only trigger an RFE (request for further evidence) not a denial.

If USCIS sent you the whole package back (including your check) it means they want you to correct whatever information is missing and re-send. Did you sign Part D: Penalties, certification and petitioner's signature. of the I-129F? Maybe that's what's missing?

This is the first letter I've received. It states 'it can not be accepted, as it has not been signed.'

Can you please post the entire contents of the letter, including who it was from? You're only giving us snippets of information, and we can only guess based on that.

The letter reads:

'The above application or petition, along with any check or other form of payment is attached. This application or petition cannot be acceppted, because it has not been signed. Since the case is not properly filed, a priority or processing date cannot be assigned. The applicant or petitioner must sign the application or petition form in the appropriate plac.e

After the application or petition form is properly signed, please return the entire package, including any fee payment which we have returned as part of this package to the address listed bleow. To speed processing, please leave this note on top.'

Sorry, I should have known better and posted this note from the start. I guess I'm just not thinking straight, because my fiance is going through some really tough stuff at the moment, and if he knew our petition was being delayed, I just don't know how he'd cope.

I think its just human error on the part of USCIS. Sign the petition in blue ink, so the difference between copy and original can be clearly seen and re-send with the letter your received on-top of the package (as instructed).

I got a letter in the mail yesterday saying that my fiance petition had been denied due to lack of signature. I've check over everything 100 times and have found no missing signature. I'm starting to wonder if I confused the original with the photocopy (all look the same to me). Fair enough if this is the case, but the letter doesn't state anything to indicate that the problem is due to the lack of an original signature. It just seem to say there isn't one at all. It also only make reference to the petition or application itself. No mention of specific forms (e.g. G 325a).

What I think I should do is resend the package with a new I 129F form with today's date and a brand new signature. Should I fill out a new G-325A as well though? It never made reference to this form, but I'm paranoid now. It just said 'application or petition'. My fiance isn't here now, so I'm a bit screwed if we have to fill those out again. I tried that 1 800 number, but they were no help.

The anxiety is seriously setting in here as I'm sure it is for many others of you.

My printer is so good I sent a photocopy of one of the forms. They caught it and sent me RFE. Just sent another form and signed it with blue ink.

Fill Out Form & Sign are two different things, for instance many signatures are barely legible hence most signatures are accompanied by "Printed Name".

In fact signing documents in blue ink is common practice as to easily distinguish original from copies. The Fill out in black ink requirement is helpful for organizations that use OCR (Optical Character Recognition) which usually scans the document in black & white so the black ink gives crisper edges than blue.

read the pinned topic above about how petitions are handled. For a missing signature they do not DENY the petition. You get an RFE. When you get the RFWE you will see exactly what is missing...provide what is missing and get back on track. Do not send anything until you have the RFE in hand. Anything you send without that will only confuse matters.

Gary, if you read the rest of the thread you'll see that the petition was not DENIED, it was REJECTED at the time of submission and check returned undeposited. It sounds like the rejection may have been a USCIS error, but in any case the OP needs to resubmit the petition.
