What do I do?

Hi all,

I'm a new poster here, but long time reader.

I got a letter in the mail yesterday saying that my fiance petition had been denied due to lack of signature. I've check over everything 100 times and have found no missing signature. I'm starting to wonder if I confused the original with the photocopy (all look the same to me). Fair enough if this is the case, but the letter doesn't state anything to indicate that the problem is due to the lack of an original signature. It just seem to say there isn't one at all. It also only make reference to the petition or application itself. No mention of specific forms (e.g. G 325a).

What I think I should do is resend the package with a new I 129F form with today's date and a brand new signature. Should I fill out a new G-325A as well though? It never made reference to this form, but I'm paranoid now. It just said 'application or petition'. My fiance isn't here now, so I'm a bit screwed if we have to fill those out again. I tried that 1 800 number, but they were no help.

The anxiety is seriously setting in here as I'm sure it is for many others of you.

I would contact USCIS and speak to a superzisor bcause this doesnt sound right, generally if its a missing siganture they issue a RFE and request you send the information/ form back with the signature.

I didn't think this was normal. I mean, it does say I can re-apply and send them the package back with the new information. It just doesn't tell me where the signature was missing and I can't spot it for the life of me. I've checked every form as well as all the letters (intent to marry, cover letter, etc.). none missing. Now if it is a case that I accidently sent a photocopy, I would have thought it would make reference to that somewhere. The fact that it says the signature is missing from the 'application/petition' makes me suspect it's the I-129F form and nothing else. I'm just guessing though. They aren't throwing me any specific info.

Did they not even cash your check? Did your whole packet come back to you?

If it's an outright denial and not an RFE as mentioned, I think the safest thing to do is to start over on all the forms and the letters of intent.

Things requiring original signatures are: I129f, G325a (all copies, both yours and your fiance's), and letters of intent. (oh, and your check, of course. )

Your fiance can print out his side and mail it to you - should get here within a week. Also, try signing with blue ink - then you can tell the difference between original and photocopy (and so can they)

Don't worry about printing on different size paper, half our packet was A4 (or whatever) from what Nik sent to me.

Its not its weird!! also if it was a case of them thinking it was not an original they usually issue an RFE for that as well requesting the original signed document.

As the other person asked tho also, did they send the entire thing back to you without cashing the payment and everything?

I did call the 1 800 number listed on the letter, but they told me they were unable to help and have no access to that information or even a copy of the I-129F. What they exist for, I'm not sure. They told me to contact a lawyer, which isn't really a realistc or helpful option to be honest. Especially when I'm sure it's something quite simple. I just don't know what I need to do to fix it, as the letter is so vague. I think they want me to re-fill out the I-129F form, but I'm just guessing as there's no specific information.

No, not cashing the check means you haven't even filed yet. You have to have a filing to get to an adjudicator who would send the RFE. It means that you didn't make it out of the mail room where they take out the check and do an initial scan for things like signatures. That means you don't have a case number or anything, so it's no good to try to send in just one form or another, because there's no case to match them up to.

That the letter tells you to send "the package" back tells me that you should send a complete application + supporting docs back to them. I am not an expert on this sort of thing, but I thought you got the whole thing mailed back to you (then you could be sure they didn't cash TWO big checks from you). That alone might be worth a call to figure things out, but in the mean time, I'd have your fiance get to work on sending you new originals signed in blue.

I did call the 1 800 number listed on the letter, but they told me they were unable to help and have no access to that information or even a copy of the I-129F. What they exist for, I'm not sure. Print out the I-129F again, sign w/ a blue pen instead of black. If you can,have someone else look over the application to check everything. (It never hurts to have a fresh pair of eyes double-check everything). Once you're assured that all Ts are crossed and I's dotted, just , re-package and re-send. You should be fine. Sometimes USCIS mistakenly rejects an application, based on such a thing as a missing signtaure (even though signature is present) or incorrect filing fee (even though the correct amount is included). No rhyme or reason.

Can you please post the entire contents of the letter, including who it was from? You're only giving us snippets of information, and we can only guess based on that.

My printer is so good I sent a photocopy of one of the forms. They caught it and sent me RFE. Just sent another form and signed it with blue ink.
