Hello

I have spent alot of time lurking on this board, as well as on the US immigration site. I have tried to educate myself in all the paperwork that will be required in the coming months as well as making sure I had the required paperwork or got them ordered if I didnt. I think that my fiance and I will be able to file early in the new year. Here is where Im lacking some understanding.

I was told, by a woman here on this board who brought her fiance from Australia to the USA that my fiance had to work for 2 years, submit 2 years of tax returns as proof that he could afford the 125% over poverty. Now as shes done all the paperwork, I believe her .. yet I cannot find anything anywhere stating this 2 year point. So I started checking into co-sponsers .. it kept mentioning that the co-sponser had to be within the same house hold as my fiance .. then I came across the word joint sponser ... but I cant find who would be a joint sponser .... just anyone ? If anyone can prove or disprove this 2 year thing, or the difference between a co and a joint sponser ... anyones help would be greatly appreciated as this seems to be the only grey area I have.

Oct. 2008 - He came to Canada to meet me

Dec 25 2009 officially engaged

March 2010 - sent off I-129F

March 27 2010 - Vermont receives package :)

April 3 2010 - Informed through mail that cheque is cashed NOA1

May 28 2010 - RFE notification ( yeah Im online checking alot >.< )

June 5 2010 - RFE hardcopy received

June 18 2010 - RFE returned ( had done it June 7 - but USPS returned grrrr )

--- case says we should hear from them in 60 days from June 18 ---

June 23 - Touched

Aug4 - Email notification of NoA2 :)

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

Oct. 5 2010 Interview Passed

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

Check cashed through bank - notification June 9

You cannot find that because it is wrong. He must show evidence of support (actually for the I-134 it is 100% of poverty level, but for the I-864 later it will be 125%, so may as well get that over with) The first proof will be given at the visa interview. You need nothing about financial support to file the petition. He cpould be unemployed today, file the petition today and get a job before the interview and you will be fine.

If, at the time of the interview he has a CURRENT, verifiable income in excess of the guidelines, you should be fine. He will normally attach only one year's income tax return and the past year's income really has no affect if he currently makes enough. Not to worry. That someone was successful by submitting more than required, does not make it a requirement. This is someone giving advice based on what they did as being required, rather than reading and understanding the rules of what is really required. The extra year's tax return or whatever, had no effect on her approval. Just because someone did all the paperwork and was usccessful does not mean you are obliggated to do what they do. For example, it is NOT necessary to submit the foreign benficiaries passport or birth certificate with the petition, no matter how many people have done so. Repeating incorrect information...no matter how many times it is repaetaed, does not make it correct.

For most consulates, any US citizen or permanent resident can be a joint (or "co-") sponsor. It is consulate specific whether they accept a co-sponsor or not.

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
