Prior to this final rule, aliens with HIV infection were considered to have a communicable disease of public health significance and were thus inadmissible to the United States per the Immigration and Nationality Act (INA). While HIV infection is a serious health condition, it is not a communicable disease that is a significant public health risk for introduction, transmission, and spread to the U.S. population through casual contact. As a result of this final rule,

aliens will no longer be inadmissible into the United States based solely on the ground they are infected with HIV, and they will not be required to undergo HIV testing as part of the required medical examination for U.S. immigration. This final rule is effective January 4, 2010.

If the person does have HIV, are they required to tell the petitioner? That would be my only concern.

I think if they're not tested for it, it would be none of USCIS or the Consulate's concern.

I know in the hospital setting if a patient has an HIV test and comes back positive, his/her spouse does NOT have to be notified if that pt desires so!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

OMG!!!!!!!!!! I sure am one that says /thinks that it should be much easier to be reunited with your loved one but THAT is definitley NOT something I agree with !!

Immigration Reform is badly needed but before you let people with HIV (that MIGHT spread it) into the Country ,you ought to lower the fees for Immigration and grant wives?husbands of US Citizens that have went through the entire Immigration Process a) a non conditional Green Card and B) the Citizenship earlier.

Honestly I am shocked by this news !!

I have no idea at all why they had to eliminate THAT rule.I mean just imagine.....the person coming over HAS HIV and DOES NOT tell their spouse.....And I do believe that there will be people that will do exactly that.They should at least test new Immigrants (especially K1 and K3) and then the Consulate should be required to inform the Petitioner in case the test comes up positive. Entering the Country with HIV is slightly different,but I am NOT for it unless the HIV Patient can PROOF that he/she got the Virus due to a medical mistake like a blood transfusion.

i understand the lifting ... but obviously only 2 person with HIV should be married... i mean.. AND THEY Have to let them know still.. geez... that will be abused i tell you...

Some people type before they get all of their facts.

HIV is no longer a death sentence. Due to excellent medical breakthroughs someone with HIV can live a full and LONG life. 20 years ago it would mean death in ten years after diagnosis (this is an average). Now? You can live to your 70s, 80s and beyond with careful medical management.

You can also be married to someone with HIV and, as long as you take precautions, have a full and healthy sex life without risking your partner's health. Sometimes love is just worth it to many.

HIV is NOT the disease of promiscuity anymore. I'd say it is more the disease of bad luck.

I think that if both parties are aware of the diagnosis and have the means to pay for treatment then the lifting of the ban is a good thing.

Some people just haven't taken the time to learn the facts. People with AIDS aren't just going around and spreading it indiscrimately. As it was said, it's mostly a disease of bad luck now.

My question for you...what the heck took them so long to send you your green card??? :blink:
